This class action challenges the U.S. Department of Homeland Security’s (DHS) alleged policy of terminating student visa holders’ SEVIS records based on criminal records that did not interfere with their educational progress. On April 7, 2025, represented by private counsel, the plaintiff C.S., an F-1 student visa holder in Pennsylvania, filed this lawsuit in the U.S. District Court for the Western District of Pennsylvania against DHS, Immigration and Customs Enforcement (ICE), and senior officials in their official capacities. On April 14, C.S. filed a Verified First Amended Complaint, adding a second named plaintiff, D.T., another F-1 visa holder whose SEVIS record was terminated based on a traffic stop in Tennessee.

This case was assigned to Judge William Shaw Stickman IV.

The plaintiffs alleged that DHS terminated their SEVIS records—and therefore their immigration status—without notice or opportunity to be heard, and based on criminal records that were either dismissed or expunged. C.S. had been charged with disorderly conduct and public drunkenness, which were withdrawn and expunged. D.T. had a traffic violation from Tennessee that resulted only in court costs and no criminal record.

The plaintiffs filed the case as a putative class action on behalf of similarly situated student visa holders nationwide. They alleged violations of the Administrative Procedure Act (APA), including arbitrary and capricious agency action and failure to act in accordance with law, as well as constitutional violations of procedural due process under the Fifth Amendment. They sought a temporary restraining order (TRO), preliminary and permanent injunctive relief, and declaratory judgment.

On April 15, the court granted the TRO in part, enjoining defendants from initiating deportation proceedings during the pendency of the preliminary injunction motion, but declining to immediately reinstate the plaintiffs’ SEVIS records. ICE subsequently restored the plaintiffs’ SEVIS records to “Active” status and issued a new internal policy governing SEVIS terminations on April 26. In response, on April 28, the government notified the court that plaintiffs had received their requested relief and asserted the case was moot.

On April 29, the court vacated the TRO considering these changed circumstances and canceled the scheduled preliminary injunction hearing. At a May 20 status conference, the parties informed the court that they were discussing potential resolution. As of a June 3 status conference, they still had not reached a resolution. The next status conference is set for July 1, unless the parties have stipulated to dismissal.

The case remains ongoing.
