California state law reflected this waiver, and between 2023 and 2025, the Environmental Protection Agency (EPA) granted California’s requests for three waivers concerning regulation on Advanced Clean Trucks, Advanced Clean Cars, and Omnibus Low NOx. On May 22, 2025, Congress adopted three resolutions disproving these waivers, stating that they were unlawful under the Congressional Review Act (CRA). 

On June 12, 2025, eleven states —  California, Colorado, Delaware, Massachusetts, New Jersey, New Mexico, New York, Oregon, Rhode Island, Vermont, and Washington — represented by the Attorney’s General of their respective states, filed this lawsuit in the United States District Court for the Northern District of California against the United States of America, President Donald Trump, and the Environmental Protection Agency and its Administrator. The plaintiffs argued that Congress did not have the power to negate a state rule after decades of the federal waiver existing. They contended that the defendants actions were (1) ultra vires, (2) arbitrary and capricious under the Administrative Procedure Act (APA), (3) unenforceable under the CRA, (4) a violation of the take care clause of Article II, Section 3 of the Constitution, (5) a violation of the separation of powers principle, (6) a violation of the principles of federalism in the Tenth Amendment, and (7) defiance of federal law by federal officials. The plaintiffs requested declaratory and injunctive relief with the ultimate objective of allowing EPA waivers to stand and declaring the congressional resolutions unlawful.

The case was assigned to Judge Haywood S. Gilliam. 

A series of groups went on to file motions to intervene as plaintiffs and defendants in the case. First, an association of over three dozen companies focused on promoting the adoption of electric vehicles, the Zero Emission Transport Association (ZETA), filed a motion to intervene as a plaintiff on July 25. Then, on August 4, thirteen corn growers' associations filed a motion to intervene as defendants, arguing that the Clean Air Act waivers for California allowed the state to abruptly cut off the sale of internal combustion vehicles (which use corn as a primary source for the ethanol in gasoline) and disrupt supply chains. On August 6, another group filed a motion to intervene as defendants, consisting of 3 companies: American Fuel & Petrochemical Manufacturers, American Petroleum Institute, and the National Association of Convenience Stores. They aimed to represent “producers, refiners, distributors, and retailers” of fuel in the U.S. On September 5, the Alliance for Automotive Innovation and the National Automobile Dealers Association filed a motion to intervene as defendants. On September 15, Western States Trucking Association, Inc., and Construction Industry Air Quality Coalition, Inc. filed the same motion.

The EPA went on to file a motion to dismiss on September 19. In the motion, the defendants argued that all three of California’s recent waivers should be struck in accordance with Congress’s regulations and that the action should be dismissed in its entirety.

The plaintiffs submitted a notice of two other pending actions on September 26: Daimler Truck North America LLC v. California Air Resources Board, and American Free Enterprise Chamber of Commerce v. Engine Manufacturers Association. Plaintiffs stated that these suits substantially overlapped with the case in question, acknowledging that transfer may be appropriate if necessary.

On October 3, the defendants filed a stipulation and proposed order requesting a delay on their response deadline in light of the government shutdown on October 1. The court granted the stipulation on the same day, moving the deadline to the prospective end date of the shutdown.

The government shutdown left most employees of the EPA unable to work, so the defendants filed an administrative motion for a stay of all proceedings on October 29

On October 10, the plaintiffs submitted their amended complaint. As a result, Judge Gilliam, Jr., terminated the defendants’ earlier motion to dismiss as moot. Defendants filed a motion to dismiss the amended complaint on November 17. This came following the end of the government shutdown and the termination of any motions delaying proceedings due to that circumstance.

Defendants submitted a statement on November 24 to specifically address the Plaintiffs' notice of pendency of other actions. Plaintiffs stated that due to the overlap of this case with others, it might be appropriate to transfer the case at hand to the Eastern District. Defendant's statement urged the court not to transfer.

This case is ongoing.
