This is a case about the unlawful arrest and detention of a paroled asylum-seeker. On June 5, 2025, a Mexican national filed this lawsuit in the U.S. District Court for the District of Oregon. He sued the ICE Seattle Field Office Director, the U.S. Immigration and Customs Enforcement and its Acting Director, the Department of Homeland Security Secretary, and the Attorney General under 28 U.S.C. § 2241, the Fifth Amendment’s Due Process Clause, and the Administrative Procedure Act. Judge Michael H. Simon was assigned to the case.

The petitioner claimed that after being lawfully paroled into the U.S. in July 2023 due to cartel threats in rural Mexico, receiving work authorization, and complying with all immigration requirements, he received a mass email on April 11, 2025, from the Department of Homeland Security stating his parole was being terminated and that he should leave the U.S. Despite this, he was arrested without cause at a scheduled June 5, 2025, immigration hearing in Portland, Oregon, before any removal order was entered. He argued that ICE lacked the authority to revoke parole and detain him absent individualized cause, violating his Fifth Amendment rights and federal parole regulations. Represented by private counsel from Innovation Law Lab, the petitioner sought immediate release from detention, a declaration that his detention was unlawful, and an injunction against further detention without due process.

The same day the petition was filed, Judge Simon barred ICE from transferring the petitioner outside the district without notice. On June 17, 2025, the petitioner moved for release on bail, supported by declarations from family, his employer, and counsel. Then, following a July 1 hearing, Judge Simon orally ruled that the April 11 email did not lawfully rescind the petitioner’s parole because the procedures used materially violated federal immigration laws and regulations. Consequently, the petitioner’s arrest on June 5 and subsequent detention were unlawful. The court ordered the government to release the petitioner immediately. The petitioner was released later that evening after the hearing and the court’s oral ruling.

On July 9, 2025, the court granted the habeas petition in a written decision, holding that ICE’s actions violated due process and federal law. 2025 WL 1898025. The court found that the government’s termination of the petitioner’s parole was unlawful, as well as arbitrary and capricious.

This case is ongoing.
