HHS (Department of Health and Human Services) Secretary Robert F. Kennedy issued a "Secretarial Directive" ordering the CDC to remove the recommendation that children and pregnant women receive the Covid vaccine from the CDC immunization schedules. Less than two weeks after the issuance of Kennerdy’s directive, on July 7, 2025, several medical organizations, as well as an individual plaintiff, filed this lawsuit in the U.S. District Court for the District of Massachusetts against the U.S. Department of Health and Human Services (HHS) and its Secretary; the Food and Drug Administration (FDA) and its Commissioner; the National Institutes of Health (NIH) and its Director; the Centers for Disease Control and Prevention (CDC) and its Acting Director; and Does 1-50. The individual plaintiff is a pregnant physician who seeks a COVID-19 vaccine despite the directive. The plaintiffs are represented by Epstein, Becker & Green. In an amended complaint filed on July 23, 2025, a Jane Doe 2 was added as well as the Massachusetts Chapter of the American Academy of Pediatrics (MCAAP). In a second amended complaint, a Jane Doe 3 was added as a plaintiff. This case has been assigned to Judge William G. Young.

The individual plaintiffs, all pregnant individuals, claim they have had trouble receiving the Covid vaccine after the directive was issued. Both Jane Doe 2 and Jane Doe 3 have had experiences of themselves or their families being rejected for the Covid vaccine at various pharmacies since the directive. The organizational plaintiffs assert the directive has and will continue to adversely affect the physician-patient relationship by creating confusion, and “inhibiting the ability of health care providers to practice according to the standard of care required of them.”

The plaintiffs brought this suit under the Administrative Procedures Act (APA). They alleged that the Secretarial Directive was unlawful as well as arbitrary and capricious. The amended complaint added a new argument that the directive is contrary to 42 U.S.C § 245(a), a statute requiring the Secretary to conduct an "evidence-based campaign to increase awareness and knowledge of the safety and effectiveness of vaccines" and "combat misinformation." The plaintiffs requested the directive be declared unlawful and that the defendants be barred from enforcing or publicizing the directive.

The amended complaint provided significantly more detail regarding the Advisory Committee on Immunization Practices (ACIP), which plaintiffs hold have been foundational in American vaccine policy. The complaint specifies that four of the new ACIP members, after Secretary “retired” 17 members of the committee, have no expertise in vaccines, infectious diseases, or immunology, and have "pronounced anti-vaccine views." The amendment also added an allegation that the Secretary testified in a congressional meeting that there was no science supporting the recommendation that pregnant women be vaccinated.

The plaintiffs separately motioned for preliminary relief on July 7, 2025. However, they moved to withdraw this motion on July 9 and claimed that it was unopposed by the defendants. The plaintiffs stated their intent to refile the motion. The plaintiffs also filed a motion on July 7, 2025 seeking a protective order allowing the individual plaintiff to proceed under the pseudonym Jane Doe. The court granted this motion.

On July 16, 2025, Jose A. Perez, a retired Infectious Disease Physician Assistant, filed a motion to intervene to participate as a defendant. Perez supports removing the Covid-19 vaccine from the CDC’s recommended immunization schedules, claiming that pediatricians become eligible for bonus when children receive the Covid-19 vaccine. The court denied Perez’s motion to intervene and invited him to file a brief amicus curiae instead. Perez appealed the court’s action.

On July 29, 2025, the plaintiffs filed another motion seeking a preliminary injunction, declaratory relief, and request for expedited consideration. At a case management conference held on July 31, 2025 the court held that plaintiff’s motion would be "collapsed with trial on the merits in accordance with Rule 65(a)," and set a motion hearing on September 3, 2025 regarding any motion to dismiss filed by defendants. A joint motion was filed to reschedule this hearing to a later date.

On September 3, 2025 defendants filed a motion to dismiss the complaint due to lack of subject-matter jurisdiction, claiming that the individual plaintiffs and the organizational plaintiff lack standing. On the same day after getting leave from the court, plaintiff filed a second amendment complaint to add plaintiff Jane Doe 3.

After being pushed back several times, a motion hearing was set for October 8, 2025 to address defendant’s motion to dismiss. The court then cancelled this hearing and bench trial set for October 14, 2025 - without specifying an alternative future date. On October 1, 2025 defendants filed an unopposed motion to say the deadline for their reply pending the government shutdown. The court ordered the stay.

On October 20, 2025, Plaintiffs moved to continue the case during the government shutdown, due to the case being “about the safety of human life.” Two days later, Judge Young entered an order reassigning the case. The case was reassigned to Judge Brian E. Murphy. The court then scheduled a hearing for October 30, 2025, to rule on Plaintiffs’ motion to continue. After the hearing, the court lifted the stay and ordered a briefing schedule – including ordering defendants to file a status report by November 11, 2025, about the compilation timeline for disclosing their administrative record to the plaintiffs.

In accordance with the briefing schedule, plaintiffs filed a third amended complaint on November 5, dropping both the NIH and the FDA as defendants. Plaintiffs asked the court to grant more structured relief to reinstate the ACIP and condemn Secretary Kennedy’s changes to the committee. Additionally, in response to the CDC downgrading the designation of the Covid-19 vaccine from a recommended vaccine to a ‘shared clinical decision making’ vaccine in May 2025, plaintiffs asked the court to declare unlawful and set aside the changes to the CDC adult immunization schedules for adults under the age of 65.
