This is a case challenging the federal government's decision to remove the recommendation that children and pregnant women receive the Covid vaccine from the CDC immunization schedules.

The Secretary of the U.S. Department of Health and Human Services (HHS) issued a "Secretarial Directive" ordering the CDC to remove the recommendation that children and pregnant women receive the Covid vaccine from the CDC immunization schedules. The Secretary had acted without consulting the Advisory Committee on Immunization Practices (ACIP), which had been responsible for making recommendations to the CDC about immunization schedules. 

On July 7, 2025, several medical organizations and a pregnant physician who sought a COVID-19 vaccination filed this lawsuit in the U.S. District Court for the District of Massachusetts. The plaintiffs sued the HHS and its Secretary, along with other federal health agencies and officials, all named in their official capacities, asserting Administrative Procedure Act (APA) violations. They alleged that the Secretary’s decision to remove the recommendation was baseless, contradicted prior congressional testimony, and undermined vaccine infrastructure. The plaintiffs sought declaratory and injunctive relief barring the defendants from enforcing the challenged Directive, along with attorney’s fees. This case was assigned to District Judge Brian E. Murphy.

On July 23, 2025, the plaintiffs filed an amended complaint, adding the Massachusetts Chapter of the American Academy of Pediatrics (MCAAP) and an anonymous individual as plaintiffs while strengthening their factual allegations. 

On July 29, 2025, the plaintiffs filed a motion for a preliminary injunction, declaratory relief, and a request for expedited consideration. They argued that they were likely to succeed on the merits, that they would suffer irreparable harm absent injunctive relief, and that the balance of equities and public interest weighed in their favor. 

On September 3, 2025, the plaintiffs filed a second amended complaint, adding an anonymous individual plaintiff while strengthening their factual allegations. That same day, the defendants filed a motion to dismiss for lack of subject-matter jurisdiction, arguing that the plaintiffs lacked standing. 

On October 1, 2025, the defendants filed a motion to stay the deadline for their reply in support of their motion to dismiss pending the government shutdown. The next day, the court ordered the stay.

On October 20, 2025, the plaintiffs moved to continue the case during the government shutdown, arguing that this case was an exception to the shutdown because it entailed “activities necessary for the safety of human life”. Ten days later, the court lifted the stay for reasons stated on the record.

On November 5, 2025, the plaintiffs filed a third amended complaint, removing both the NIH and the FDA as defendants and asking the court to grant more structured relief to reinstate the ACIP and condemn the Secretary’s changes to the committee.

On November 19, 2025, the defendants filed a motion to dismiss, arguing that the court lacked subject-matter jurisdiction over the matter and that the plaintiffs failed to state a claim for relief.

On January 6, 2026, Judge Murphy denied the defendants’ motion to dismiss. The court found that the organizational plaintiffs, particularly the American Academy of Pediatrics, had standing because they suffered concrete injury by having to divert resources to counsel members affected by the challenged actions. On the merits, the court found that the plaintiffs plausibly alleged Federal Advisory Committee Act violations where new ACIP members were appointed based on alignment with the Secretary’s views rather than fair balance. 814 F.Supp.3d 150.

On January 26, 2026, the plaintiffs filed a motion for a preliminary injunction barring the enforcement of the challenged Directive. They argued that they were likely to succeed on the merits, that they would and already have suffered irreparable harm absent injunctive relief, and that the balance of equities and public interest weighed in their favor. 

On February 17, 2026, the plaintiffs filed a fourth amended complaint, strengthening their factual allegations and requesting the court to enjoin upcoming ACIP meetings.

On February 18, 2026, proposed intervenor-defendants filed an emergency motion to intervene. The proposed intervenors consisted of Children’s Health Defense (CHD), parents whose children died under the schedule the plaintiffs sought to restore, and physicians whose medical licenses were revoked for practicing the individualized medicine the government’s new Shared Clinical Decision-Making (SCDM) policy permitted. On February 27, 2026, the court denied the emergency motion to intervene.

On March 16, 2026, the court granted the plaintiffs’ motion for a preliminary injunction in part, staying a January 2026 memo, the appointments of the newly selected ACIP members, and any votes taken by that improperly constituted committee. Judge Murphy held that the revising of the childhood immunization schedule and reconstitution of ACIP likely violated the APA. The court further found that the plaintiffs were likely to suffer irreparable harm without an injunction, as potentially flawed vaccine recommendations constituted a significant risk to public health. Finally, the court found that the balance of harms and public interest favored relief, because maintaining the prior vaccination framework imposed minimal burden on the government, while there was no public interest in allowing likely unlawful agency action to continue. 823 F.Supp.3d 141.

On March 25, 2026, proposed intervenors appealed the court’s denial of their emergency motion to intervene to the U.S. Court of Appeals for the First Circuit. (Case Number 26-1325)

On April 4, 2026, the proposed intervenors filed a motion to stay the preliminary injunction in the First Circuit pending appeal. Five days later, the First Circuit denied the motion because it should have been filed in the district court first.

On April 20, 2026, the proposed intervenors filed a motion to stay the preliminary injunction in the district court pending appeal. They argued that the April 1, 2026 renewal of the ACIP charter eliminated the factual basis for the appointments stay.

On April 21, 2026, the plaintiffs filed a partial motion to dismiss the proposed intervenors’ appeal in the First Circuit. They argued that the proposed intervenors lacked standing to appeal the district court order nor could they obtain party status by invoking pendent appellant jurisdiction over the preliminary injunction.

On April 23, 2026, the defendants filed a motion to stay proceedings pending the resolution of any appeal of the preliminary injunction in the district court. They argued that a stay would promote judicial economy.

On April 29, 2026, the defendants filed a notice of appeal of the court’s March 16 order granting a preliminary injunction to the U.S. Court of Appeals for the First Circuit. (Case Number 26-1503)

On May 1, 2026, the district court denied the defendants’ motion to stay proceedings. Judge Murphy held that the defendants did not establish a good cause for a stay to be warranted. Five days later, the district court denied the proposed intervenors’ motion to stay the preliminary injunction. The court found that the movants had failed to provide any authority that they had standing to seek a stay of the district court’s prior order, since they acted solely as amici curiae. 

On July 7, 2026, the defendants filed a renewed motion to stay proceedings pending appeal and to postpone record disputes in the district court. They argued that the First Circuit would be resolving issues that the district court would depend on for its own resolution.

On July 23, 2026, the district court granted the defendants’ motion to stay until September 3, 2026.
