On March 4, 2024, six incarcerated individuals in Pennsylvania filed a lawsuit in the Eastern District of Pennsylvania challenging the constitutionality of solitary confinement in the Pennsylvania Department of Corrections. The individuals sued the Pennsylvania Department of Corrections, the Secretary of Corrections, the former Secretary of Corrections, the Executive Deputy Secretary for Institutional Operations at the Pennsylvania Department of Corrections, and the Director of Psychology at the Pennsylvania Department of Corrections. The plaintiffs seek an injunction requiring that Defendants end the solitary confinement of themselves and Class Members and provide them with functional avenues for re-entry into the general prison population. Plaintiffs also seek damages from Defendants for the violation of their constitutional and statutory rights. This suit is the first of its kind seeking to end prolonged and indefinite solitary confinement and prohibit all solitary confinement for anyone with a mental health diagnosis. All of the named plaintiffs have documented mental illness diagnoses that drastically worsened during repeated and prolonged periods of solitary confinement.

Plaintiffs' complaint alleged that defendants have violated their rights under the Eighth and Fourteenth Amendments to the U.S. Constitution, the Americans with Disabilities Act, and the Rehabilitation Act. In the complaint, Plaintiffs requested class action certification. Plaintiffs are represented by the Abolitionist Law Center, Pennsylvania Institutional Law Project, and Dechert LLP.

On May 13, District Judge Timothy J. Savage granted defendants' motion to split Hammond v. Department of Corrections into three separate cases, each with individualized focal points. On May 29, an amended complaint was filed in Hammond v. Department of Corrections, focusing the case on solitary confinement of people with mental health conditions. The two additional cases are Henderson v. Harry, focusing on solitary confinement of three years or more, and Walker v. Harry, focusing on due process challenges to those in solitary on the Restricted Release List or the Intensive Management Unit.

The Pennsylvania Department of Corrections filed a motion to  transfer the case from the Eastern District of Pennsylvania to the Middle District of Pennsylvania. Plaintiffs' counsel oppose for reasons including that five of six plaintiffs are from Philadelphia and Philadelphia is the city most impact by the Department of Correction's solitary confinement practices. On November 12, 2024, the oral argument on this motion was heard.

On January 8, 2025, District Judge Timothy Savage granted defendants' motion to transfer the case to the Middle District of Pennsylvania.

This case remains ongoing.
