The "Final Rule," officially titled “Patient Protection and Affordable Care Act; Marketplace Integrity and Affordability,” was issued by the U.S. Department of Health and Human Services (HHS) on June 25, 2025. The rule implements changes to Affordable Care Act (ACA) eligibility and enrollment processes, which HHS estimates could result in 750,000 to 2,000,000 individuals losing health coverage. Key provisions include shortening the Open Enrollment Period to nine weeks, increasing verification requirements for Special Enrollment Periods (requiring 75% of SEPs to be verified before coverage), and excluding “sex-trait modification procedures” from Essential Health Benefits—a newly introduced and undefined term. This case challenges the Final Rule.

On July 17, 2025, the State of California, along with twenty other states, filed this lawsuit in the U.S. District Court for the District of Massachusetts. The plaintiff states sued the Centers for Medicare & Medicaid Services and its Administrator, and the Secretary of HHS, under the Administrative Procedure Act. Judge Nathaniel M. Gorton was assigned to the case.

Represented by their respective Attorneys General, the plaintiff states sought a preliminary injunction and stay to prevent the implementation or enforcement of the challenged provisions of the Final Rule. 

Plaintiffs asserted that the Final Rule could deprive up to 1.8 million individuals of health insurance coverage and significantly increase healthcare costs for the plaintiff states. They argued the rule was contrary to law, arbitrary and capricious, and would harm both the states and their residents. They contended it imposed excessive verification burdens for Special Enrollment Periods, deterring even eligible individuals from enrolling; unlawfully excluded "sex-trait modification" from Essential Health Benefits, creating financial barriers to medically necessary care; and introduced changes inconsistent with prior policy and evidence. They also challenged the 23-day public comment period as procedurally inadequate and claimed HHS disregarded widespread public opposition to the rule.

After a hearing on August 13, 2025, the court granted and denied in part the plaintiffs' preliminary injunction and entered a stay enjoining certain provisions of the Marketplace Integrity and Affordability Rule from taking effect on August 25, 2025. The Court found the plaintiffs met their burden of showing they had a strong likelihood of succeeding on the merits of their challenges to seven provisions of the Rule, but failed to meet their burden on two provisions. For the seven provisions the Court felt the plaintiffs could successfully challenge, they further found that the plaintiffs showed they “will face irreparable harm if the challenged portions of the Rule are not enjoined.” Consequently, the court held the “balance of equities and the public interest weigh in favor of a stay” regarding the likely successful seven provisional challenges.

The Court’s ruling on the specific provisions the plaintiffs challenged is reflected in the following from its order:

The effective dates of the following provisions of the final rule entitled “Patient Protection and Affordable Care Act; Marketplace Integrity and Affordability,” 90 Fed. Reg. 27074, are STAYED pursuant to 5 U.S.C. § 705 pending a final ruling on the merits of this case:

    • The imposition of a $5 premium penalty on automatic re-enrollees, through the addition of 45 C.F.R. § 155.335(a)(3) and (n) and revisions to 45 C.F.R. § 155.330(j);
    • The revocation of guaranteed insurance coverage for individuals with past-due premiums, through revisions to 45 C.F.R. § 147.104(i);
    • The failure to reconcile policy in 45 C.F.R. § 155.305(f)(4), including the final rule’s amendments to that policy through the addition of 45 C.F.R. § 155.305(f)(4)(iii); 
    • The imposition of eligibility verification for the special enrollment period, through the revisions to 45 C.F.R. § 155.420(g);
    • The imposition of a requirement that Exchanges verify household income inconsistencies when a tax filer’s attested projected annual household income differs from “trusted data sources,” through revisions to 45 C.F.R. § 155.320(c)(3)(iii); 
    • The changes to the de minimis ranges for actuarial value calculations, through revisions to 45 C.F.R. §§ 156.140(c), 156.200(b)(3), and 156.400.

The Court DECLINES to stay the effective dates of the following provisions: 

    • The change to the measure for calculating the premium adjustment percentage set forth in 90 Fed. Reg. 27,166 through 27,178;
    • The elimination of the 60-day extension of time to resolve inconsistencies in household income data, through the removal of 45 C.F.R. § 155.315(f)(7) and revisions to 45 C.F.R. § 155.320(c)(5). 

On September 19, 2025, the Court entered a consent motion for an extension of time for the defendants to answer plaintiffs’ complaint.

The same day plaintiffs filed their complaint, they filed a motion for a preliminary injunction to prevent the government from implementing or enforcing the challenged provisions of the Final Rule.

On August 22, 2025, plaintiffs filed a letter with the court to inform them of the U.S. District Court for the District of Maryland’s recent decision in City of Columbus, et al., v. Robert F. Kennedy, Jr., et al., Case No. 1:25-cv-2114-BAH, a case challenging similar provisions of the Final Rule. This Maryland district court had granted a preliminary injunction staying five provisions of the Final Rule.

After a motion hearing in August, the U.S. District Court of Massachusetts denied the plaintiff's request for a preliminary injunction on October 1, 2025, finding that the “ACA affords the Secretary of the HHS authority to issue regulations setting standards for the ACA requirements, including exchanges and ‘such other requirements as the Secretary determines appropriate.’” 42 U.S.C. §18041 (a) (1) . 

On October 22, 2025, defendants moved to stay the proceedings during the government shutdown. The court denied defendant's motion without explanation.

After the parties concluded the best way to adjudicate the case would be through cross-motions for summary judgment based on the administrative record, they filed a joint motion asking the court to order a brief schedule on October 31, 2025. The proposed order begins with defendant’s administrative record being due in December 2025 and ends with the defendant’s reply to plaintiffs' cross summary judgment motion being due April 3, 2026.
