On August 13, 2025, the National Association of Agriculture Employees (NAAE), a labor union representing employees of the Plant Protect and Quarantine (PPQ) program within the U.S. Department of Agriculture (USDA), filed this lawsuit in the U.S. District Court for the District of Columbia against the President of the United States, the Secretary of Agriculture, and the Director of the Office of Personnel Management (OPM). Plaintiff challenged Executive Order No. 14,251, which purports to revoke the collective bargaining rights of PPQ employees on the basis that their primary function constitutes national security work. Plaintiff alleged that Defendants' actions violated the First and Fifth Amendments to the U.S. Constitution and were ultra vires.
