This case challenged Minnesota officials’ regulation of online speech through alleged misuse of consumer protection and anti-fraud laws.

On September 27, 2024, Minnesota State Representatives Christopher Kohls and Mary Franson, filed this lawsuit in the U.S. District Court for the District of Minnesota. The plaintiffs sued Minnesota Attorney General Keith Ellison and Douglas County Attorney Chad Larson, claiming that enforcement threats against their online content violated the First Amendment and was unconstitutionally vague. The lawsuit specifically challenges Minnesota Statute § 609.77, which criminalizes the distribution of “deep fake” or digitally altered media intended to influence an election or injure a candidate before an election.  Represented by private counsel, the plaintiffs sought declaratory and injunctive relief to prevent the officials from taking action against their internet postings. The case was assigned to District Judge Eric C. Tostrud and later reassigned to District Judge Laura M. Provinzino, with Magistrate Judge Douglas L. Micko also presiding.

The plaintiffs promptly moved for a preliminary injunction in October 2024. On January 10, 2025, Judge Provinzino denied the plaintiffs’ motion for a preliminary injunction, finding that only one Representative had standing and that she failed to show irreparable harm. The court emphasized that the 16-month delay in filing undercut claims of injury and that the threat of prosecution was not imminent enough. Because irreparable harm was lacking the court declined to fully analyze the merits.

On January 13, 2025, the court entered judgment denying preliminary injunctive relief under Federal Rules of Civil Procedure 58. The Representatives filed an interlocutory appeal to the U.S. Court of Appeals for the Eighth Circuit on February 7, 2025 (No. 25-1300). While the appeal was pending, the parties jointly stipulated to stay district court proceedings, and Judge Provinzino entered the stay on March 12, 2025.

As of September 2025, the case remained ongoing before the Eighth Circuit.
