This is a case challenging Texas Senate Bill 10 (S.B. 10), which required public schools to display the Ten Commandments in classrooms.

On July 2, 2025, the plaintiffs, a group of Christian, Jewish, Hindu, Unitarian Universalist, and nonreligious families with children enrolled in Texas public school districts (collectively, “the families”), filed this individual lawsuit in the U.S. District Court for the Western District of Texas. Represented by private counsel, the ACLU of Texas, the national ACLU, Americans for the Separation of Church and State, and the Freedom from Religion Foundation, the families sued the school districts under 42 U.S.C. § 1983. They alleged that S.B. 10 violated the Establishment and Free Exercise Clauses of the First Amendment, as applied to state laws through the Fourteenth Amendment. The complaint sought a declaratory judgment that S.B. 10 is unconstitutional and also sought preliminary injunctive relief to prevent the defendant school districts from complying with S.B. 10 by displaying the Ten Commandments in classrooms. The case was assigned to United States District Judge Fred Biery.

The Texas school districts moved to consolidate cases on July 14, 2025; the court denied that motion on July 22 and scheduled a preliminary injunction hearing for August 15. On July 29, the defendants moved to dismiss, arguing that the families' claims were unripe, that the families lacked standing, and that they failed to state a claim; the school districts also argued that the families were not entitled to a preliminary injunction.

On August 15, 2025, Judge Biery held a hearing on the families' motion for a preliminary injunction and the school districts' motion for dismissal. Four days later, the Austin Independent School District stipulated its dismissal as a defendant without prejudice. In light of Supreme Court and Fifth Circuit precedent regarding the Establishment and Free Exercise clauses of the First Amendment, the Austin Independent School District agreed to comply with any injunction the court issued and disclaimed any intention to enforce S.B. 10 while litigation is pending.

On August 20, 2025, Judge Biery denied defendants’ motion to dismiss and granted the families’ motion for a preliminary injunction, enjoining the defendant school districts from displaying the Ten Commandments pursuant to S.B. 10.  He held that the recent Fifth Circuit decision Rev. Roake v. Brumley, which affirmed the unconstitutionality of a similar law in Louisiana, was binding on the court and that S.B. 10 constituted religious coercion of students.

The school districts filed an interlocutory appeal of the denial of their motion to dismiss and of the preliminary injunction to the U.S. Court of Appeals for the Fifth Circuit on August 25, 2025.

On April 21, 2026, the Fifth Circuit, sitting en banc, reversed the district court's judgment, vacated the preliminary injunction, and dismissed the families' claims. 173 F.4th 576. The court declined to follow the precedent set by Stone v. Graham, 449 U.S. 39 (1980), which struck down a similar law, because the Supreme Court had jettisoned its reasoning. For the plaintiffs’ establishment claims, the court examined whether S.B. 10 resembled a founding-era religious establishment and concluded it did not because there was no government pressure to engage in religious worship, no punishment for anyone who rejects the Ten Commandments, and no instruction for teachers to proselytize students. For the free exercise claims, the court applied similar reasoning and distinguished this case from Mahmoud v. Taylor, 606 U.S. 522 (2025), holding that the mere display of religious language was not enough to constitute religious indoctrination. 

The case is ongoing.
