Represented by Democracy Forward, plaintiffs filed this putative class action on August 11, 2025, in the U.S. District Court for the District of Massachusetts on behalf of 1) non-citizen individuals whose parole status, secured through the CBP One app, was terminated with a non-individualized mass email notification, and 2) members of the Venezuelan Association of Massachusetts who waited at the U.S.-Mexico border for extended periods while awaiting opportunity to lawfully enter the United States. Judge Allison D. Burroughs was assigned to the case.

Plaintiffs claimed that defendants violated the Administrative Procedure Act (APA) because terminating the parole of plaintiffs en masse was both contrary to law and arbitrary and capricious. They sought vacatur of the parole terminations, a declaration that the terminations were unlawful under the APA, and injunctive relief prohibiting defendants from enforcing the terminations.

On September 25, 2025, defendants filed an opposition to plaintiffs’ request to file pseudononymously.

Plaintiffs filed a motion for summary judgment on October 16, 2025, requesting that the court vacate defendants’ decision to terminate the parole of the putative class and declare the mass terminations unlawful.

The next day, the defendants filed a motion to stay proceedings in light of the government shutdown. Judge Burroughs denied the stay.

On November 6, defendants filed a consolidated motion to dismiss and a cross-motion for summary judgment. Defendants argued that the court lacked jurisdiction to review DHS’s decision to terminate parole because it is a task delegated to the Secretary of Homeland Security. They further argued that, on the merits, there is no requirement that terminations of parole address individualized reasons for termination, and thereby they did not violate standard procedure.

On March 31, 2026, the court granted plaintiff’s motion to proceed pseudonymously, granted in part and denied in part plaintiff’s motion to certify a class, granted in part and denied in part plaintiff’s motion for summary judgment, and granted in part and denied in part defendants’ motion to dismiss. 2026 WL 880442. First, the court granted plaintiffs’ motion to proceed pseudonymously, finding that plaintiffs’ status as noncitizens challenging the government’s revocation of a legal status without which their presence in this country is unlawful was sufficient to establish a justified fear for their safety and the safety of their loved ones. Next, the court granted the plaintiffs’ motion for class certification but modified the proposed class definition to satisfy the commonality requirement. The court modified the class definition to read: “All individuals who (i) scheduled their appointments for entry to the United States using the CBP One app; (ii) were paroled into the United States between May 16, 2023 and January 19, 2025; (iii) had their parole terminated in April 2025 pursuant to an email substantially similar to the one reproduced at paragraph 38 of the Complaint without any further explanation; and (iv) remain in the United States.”

The court then ruled that while the government has broad discretion over parole, it violated the APA by failing to follow its own regulations and statutory requirements for ending such status. Consequently, the court vacated the terminations, effectively restoring the legal parole status of the affected class members. However, the court granted the motion to dismiss plaintiffs’ claims alleging that the parole termination improperly proceeded on a categorical basis for lack of jurisdiction. The court concluded that Congress had largely insulated discretionary parole decisions from judicial review. As a result, the court could review whether DHS complied with the procedures governing parole termination, but not the substance of DHS’s decision to terminate parole categorically. Accordingly, the court reached the merits of plaintiffs’ procedural APA challenge but not their challenge to DHS’s categorical termination policy.

Following the March 31 ruling, on April 8, 2026, plaintiffs filed an emergency motion for an order to show cause and an emergency status conference, stating that the parties disagreed about the scope of the court’s March 31 relief and the timeline for defendants to implement that relief. On April 14, 2026, the court denied the motion, finding that defendants were timely complying with the judgment. However, the court ordered defendants to confirm that parole had been reinstated for affected individuals and that any collateral consequences of the vacated terminations, including the accrual of unlawful presence, would have no legal effect.

Defendants filed the required status update on April 21, 2026. After reviewing the update, plaintiffs continued to dispute whether defendants had fully implemented the relief required by the March 31 judgment. On April 23, 2026, plaintiffs filed an emergency motion to enforce compliance with, or alternatively clarify, the court’s March 31 order, arguing that additional steps were necessary to fully effectuate the relief granted to class members.

Separately, on April 25, 2026, plaintiffs moved for an administrative stay to prevent defendants from implementing a new round of parole terminations announced on April 21, 2026. Plaintiffs argued that allowing the government to re-terminate parole would undermine the relief awarded in the case. On April 27, 2026, the court denied the motion, explaining that its March 31 order vacated procedurally defective agency action but did not create a substantive entitlement to parole. Because the newly announced parole terminations were not directly at issue in the litigation, the court declined to stay them.

Following a May 7, 2026 hearing on the plaintiff's motion to enforce compliance or clarify the court’s order, the motion remains pending. As of June 2026, this case remained ongoing as the parties continued to dispute the scope of the March 31 judgment and the steps necessary to fully implement the relief granted to class members.
