This case followed media reports revealing the Trump administration's plans to summarily deport hundreds of Guatemalan minors.

At 1:02am on August 31, 2025, ten Guatemalan unaccompanied minors (ages 10–17), represented by the National Immigration Law Center, filed this lawsuit on behalf of themselves and similarly situated children against multiple federal officials and agencies including the Department of Homeland Security and its Secretary Kristi Noem, Immigration and Customs Enforcement, the Department of Health and Human Services, the Office of Refugee Resettlement, the Department of Justice, and the State Department. Plaintiffs filed in the U.S. District Court for the District of Columbia and alleged in their complaint that the ongoing deportations violated the Trafficking Victims Protection Reauthorization Act of 2008, the Immigration and Nationality Act, and the Fifth Amendment of the U.S. Constitution through national origin discrimination and violations of Plaintiffs' due process rights.

Immediately after filing, Plaintiffs moved for a TRO to halt the impending removals, which the court -- District Judge Sparkle L. Sooknanan --  granted, at 4:22am. The court ordered the defendants not to remove any of the individual plaintiffs from the United States for 14 days absent further order of the court and ordered a hearing for later that afternoon.  After receiving notice that putative class members were in the process of being removed from the United States, the court moved the hearing to earlier in the afternoon and, at that hearing, determined that the plaintiffs had satisfied the four factors governing the issuance of preliminary relief and, therefore, ordered that the defendants not transfer, repatriate, remove, or otherwise facilitate the transport of any plaintiff or member of the putative class from the United States for 14 days absent further order.  The putative class included all Guatemalan unaccompanied minors in Department of Health and Human Services Office of Refuge Resettlement custody, as of the time the complaint was filed, who were not subject to an executable final order of removal. The court further ordered that the defendants cease all ongoing efforts to transfer, repatriate, remove, or facilitate transport, and ordered them to file a status report to address the current status of deplaning putative class members and, if all class members had not been deplaned and moved back to the custody of ORR, when they expected that to occur.  After a back-and-forth of court orders requiring updated status reports from the defendant, a final status report, filed on September 1, 2025, reported that all putative class members had been returned to ORR custody.  

On September 2, the case was assigned to District Judge Timothy J. Kelly. 

On September 3, 2025, plaintiffs filed a motion for a preliminary injunction.

Defendants ask to move the deadline for their response to Plaintiffs' 6 Motion for Class Certification to September 6, 2025. For the reasons set forth in Defendants' 25 Motion, the Court finds that this brief extension is appropriate.
