This is a lawsuit both seeking damages against a California doctor who mailed abortion medication into Texas that was used to terminate two pregnancies and challenging his ability to continue to send such medication into the state.
On July 20, 2025, plaintiff filed this lawsuit in the U.S. District Court for the Southern District of Texas. He sought to prevent the defendant from providing additional abortion medication to his partner and anyone else on behalf of a proposed class of all current and future fathers of unborn children in the state. He also sought $75,000 in damages for the wrongful death of his unborn child.
In his complaint, the plaintiff alleged that he and his partner started dating in June 2024 and in July 2024, she discovered she was pregnant. The plaintiff’s partner’s ex-husband ordered abortion-inducing medication from the defendant, who allegedly shipped the medication to his home in Galveston County. In September 2024, the plaintiff’s partner terminated her pregnancy using the medication shipped by the defendant. In late October 2024, plaintiff’s partner again became pregnant. In January 2025, the two went to a doctor’s appointment and received a sonogram of the unborn child. Later in the month, the plaintiff's girlfriend again terminated her pregnancy using abortion-inducing medication allegedly provided by the defendant. In May 2025, the plaintiff’s girlfriend again discovered she was pregnant.
Represented by private legal counsel, the plaintiff sued the defendant under Texas laws that allow individuals to be sued for wrongful death and murder for assisting a pregnant woman to obtain an abortion and that prohibit anyone other than Texas-licensed physicians from providing abortion-inducing drugs for the purpose of inducing an abortion. This case was assigned to U.S. District Judge Jeffrey V. Brown.
