On August 13, 2025, plaintiffs, prisoners subjected to strip searches that were recorded on body-worn cameras operated by La Plata County Sheriff’s personnel, filed suit in the U.S. District Court for the District of Colorado. The suit, filed under 42 U.S.C. § 1983 and the Colorado Constitution, alleged widespread and systemic violations of inmates’ constitutional rights over a five-year period from 2019 to 2024.

The prisoner-plaintiffs claim that Defendant, while serving as Jail Commander, repeatedly and unlawfully accessed and viewed digital recordings of female inmates’ strip searches stored on the jail’s evidence.com system for his own sexual gratification. According to digital forensic analysis cited in the complaint, Defendant logged into the system over 3,100 times, primarily to view such videos, including more than 117 female inmates, often from home, hotels, or other remote locations. The prisoner-plaintiffs alleged that these actions were purely prurient and lacked any legitimate law enforcement purpose.

The complaint asserted that Defendant’s conduct constituted unreasonable searches and seizures and violated the Fourth and Fourteenth Amendments, including substantive due process and equal protection guarantees. Plaintiffs further allege that the institutional defendants—La Plata County, the Sheriff’s Office, and Sheriff Smith—were liable under Monell v. Department of Social Services, citing deliberate indifference and systemic failures to train, supervise, or monitor personnel with access to sensitive video evidence. The complaint also alleges that the two defendant deputies were aware of Aber’s conduct but failed to intervene.

The class seeks to represent all female detainees held between February 14, 2019 and July 14, 2024, whose strip search videos were accessed by Defendant without legitimate cause. The prisoner-plaintiffs sought compensatory and punitive damages, declaratory and injunctive relief, and attorney’s fees. They also provided notice of intent to add Colorado tort claims following expiration of the Colorado Governmental Immunity Act notice period.

Magistrate Judge Kathryn A. Starnella was assigned to preside over the case. Several motions have been filed to consolidate this case with a related action, C.B. et al. v. La Plata County, No. 25-cv-02763, involving overlapping allegations and plaintiffs. The cases were consolidated on October 29th.
