The Act established the Financial Oversight and Management Board to “make all needful Rules and Regulations respecting the Territory or other Property belonging to the United States.” 48 U.S.C. § 2121(b)(2) (citing U.S. CONST. art. IV, § 3). The Oversight Board manages the restructuring of the public debt of Puerto Rico. The Board consists of seven members appointed by the President of the United States. Each member serves a term of three years, with no term limit and no pay. Members of the Board may be removed by the President only for cause.  48 U.S.C. § 2121(e)(5)(A)–(B). The plaintiffs in this case are members of the Board who received termination emails from President Trump in August of 2025. The emails did not articulate any cause for their termination. The plaintiffs received no other notice prior to the commencement of this suit, no hearing, and no any other opportunity to contest their removal.

The plaintiffs brought suit in the U.S. District Court for the District of Puerto Rice against President Donald Trump, the White House Personnel Office, and the Oversight Board. The plaintiffs were represented by attorneys from the Democracy Defenders Fund, Cooley LLP, Indiano & Williams, and Washington Litigation Group. The complaint alleged that terminations were unlawful and exceeded President Trump's statutory authority. The plaintiffs requested a writ of mandamus prohibiting their removal. The case was assigned to U.S. District Judge María del Rocio Antongiorgi-Jordán.

On September 22, 2025, the plaintiffs moved for a preliminary injunction. They argued that emergency relief was necessary to “preserve the status quo ante” because they suspected that the President may attempt unlawfully to replace them on the Board while the lawsuit was ongoing.

The court granted preliminary relief on October 3, 2025. 2025 WL 2813829. It reasoned that the plaintiffs were likely to succeed on their claim that the attempted removals did not satisfy the Act's "for cause" requirements, which created a statutory right to pre-termination notice and and opportunity to respond, which the plaintiffs did not receive. The court further found that the being prevented to discharging their duties as Board members constituted irreparable harm, and that preliminary relief was necessary to ensure that the court could grant final relief, as the harms might not be remediable should the plaintiffs' positions on the Board be filled in the interim. The court further noted the public interest in ensuring that the president follows the laws and, generally, that the balance of equities and the public interest weighed in favor of issuing immediate injunctive relief.  Therefore, the court preliminarily enjoined the government from executing the removal of the plaintiffs from their position.

The government appealed the preliminary injunction on December 2, 2025.

This case is ongoing.
