This case arose following Texas' implementation of SB 10, requiring every public elementary and secondary school in the state to post a state-approved Protestant version of the Ten Commandments in a “conspicuous place” in every classroom. SB 10 took effect on September 1, 2025. Parents and their minor children, representing various religious and non-religious backgrounds, filed this lawsuit on September 22, 2025 in the U.S. District Court Western District of Texas San Antonio Division against 14 public school districts in Texas. Plaintiffs, represented by Simpson Thacher & Bartlett LLP, ACLU, Americans United for Separation of Church & State, and Freedom from Religion Foundation, sued under 42 U.S.C. § 1983. Plaintiffs alleged violations of the Establishment Clause because of the Defendants’ overt preference for Protestant religion in public schools. Additionally, Plaintiffs alleged violation of the Free Exercise Clause because the posting of the Ten Commandments usurped parent-Plaintiffs authority to direct and supervise their children’s religious education and upbringing. The Plaintiffs sought a declaratory judgment, an order preliminarily and later permanently enjoining Defendants from complying with SB 10 and immediately removing any posters already on display, and an award of reasonable attorneys’ fees and associated costs. The case was assigned to District Judge Orlando L. Garcia.

A month before this complaint was filed, the same district court had already ruled that SB 10 was “plainly unconstitutional” and likely violated the Establishment and Free Exercise Clauses of the First Amendment. See Nathan v. Alamo Heights Indep. Sch. Dist., No. 25-cv-00756, 2025 WL 2417589, at *28 (W.D. Tex. Aug. 20, 2025) (cleaned up). Following that ruling, Defendants received a letter from Plaintiffs’ counsel in Nathan notifying them of the decision and warning that all school districts have an independent legal obligation to comply with it to avoid violating children’s and parents’ First Amendment rights. Despite receiving these letters, Defendants displayed the posters in classrooms or confirmed they will do so shortly.

Relatedly, in June 2025, the Fifth Circuit had reached the same conclusion, that requiring the Ten Commandments in public school classrooms was unconstitutional, in a similar Louisiana statute. See Roake v. Brumley, 141 F. 4th 614, 645 (5th Cir. 2025). However, this decision was appealed to be heard by the Fifth Circuit en banc. On October 8, 2025, the Defendants in this case filed a motion to stay proceedings pending the Fifth Circuit’s en banc decision. That motion was denied on October 21, 2025.

On October 20, 2025, Defendants filed a motion to dismiss on two jurisdictional grounds: Plaintiffs’ lack of standing (their injuries being hypothetical) and the unripeness of the Establishment Clause claim. Separate joint motions to dismiss were filed specifically for Arlington Independent School District and McAllen Independent School District. The Court granted the joint motions to dismiss for these two school districts.

On November 18, 2025, the Court denied Defendants’ motion to dismiss and granted Plaintiffs’ September 23 motion for a preliminary injunction, enjoining Defendants from displaying the Ten Commandments under SB 10 and ordering compliance by December 1, 2025. On December 17, 2025, Defendants filed a notice of appeal to the Fifth Circuit.

On February 20, 2026, the Fifth Circuit, sitting en banc, reversed course in Roake, holding that ruling on the law’s constitutionality was premature since the displays had not yet been installed. This is a critical distinguishing factor between Roake and this lawsuit, because here, some of the posters were already displayed when the Complaint was filed. Despite this critical difference, on May 29, 2026, the Fifth Circuit followed their Roake reversal and held in favor of the school districts, granting their motion to reverse and vacate the district court’s preliminary injunction as well as directing the district court to dismiss the Plaintiffs’ claims.

On August 17, 2026, the original family Plaintiffs in this case joined with the families in the Nathan case filed a petition for a writ of certiorari with the U.S. Supreme Court. They have asked the Supreme Court to hear both cases and reverse the Fifth Circuit rulings to protect their families’ religious freedom.
