On September 30, 2025, Leonardo Garcia Venegas, a U.S. citizen and construction worker, filed this class action lawsuit in the U.S. District Court for the Southern District of Alabama against White House Border Czar Tom Homan, DHS, DOJ, DHS Secretary Kristi Noem, Attorney General Pamela Bondi, and various federal agents for alleged policies of warrantless entry, preemptive detention, and continued detention. Represented by the Institute for Justice, Plaintiff asserted that the alleged policies that grant federal immigration officers sweeping search and seizure powers that, Plaintiff claims, violate the Fourth Amendment and exceed officers’ statutory and regulatory powers. Plaintiff alleges dragnet raids have been occurring on construction sites throughout this District. The officers rarely (if ever) have reasonable suspicion to suspect that the people working on or managing a particular construction site are violating immigration laws. Instead, DHS authorizes these armed raids based on the general assumption that certain groups of people in the industry, including Latinos, are likely illegal immigrants. Plaintiff sought declaratory and injunctive relief, class certification for similarly situated workers, and damages for tortious conduct. Counts I-IV target the policies, and allege violations in an official capacity. Counts V-XIII are individual liability claims involving specific officers for actions such as assault, battery, false arrest, and false imprisonment, including Bivens actions. The case was assigned to Chief District Judge Jeffrey U. Beaverstock. 

Plaintiff filed a motion for a preliminary injunction, a motion for class certification, and a motion to allow a witness to proceed under a pseudonym on October 27, 2025. In the motion for preliminary injunction, the plaintiff argued that he and other class members faced an imminent risk of irreparable harm from the government's continued enforcement of the challenged policies, which allegedly empowered agents to seize workers based solely on a "generalized demographic profile."

Following Plaintiff's filings, the defendants sought delays in the briefing schedule, citing the government shutdown from October 1 through November 12. On November 3, defendants moved to stay deadlines, which the court mooted on November 19 after the government reopened, initially setting responsive deadlines for early December. However, on November 20, the defendants filed a motion requesting a further 43-day extension. The plaintiff opposed this request the same day, arguing that the delay would allow unconstitutional harms to continue well into the New Year and requesting that, should an extension be granted, the court issue a temporary restraining order (TRO) to stop the Task Force from carrying out their alleged detention policies.

On November 21, 2025, the court granted in part and denied in part the defendants' request for an extension. Judge Beaverstock ordered the defendants to file responses to the plaintiff's motions for preliminary injunction, class certification, and use of a pseudonym by December 11, 2025, with replies due by December 18, 2025. The court separately set the deadline for the defendants to answer the complaint for January 29, 2026.
