On October 3, 2025, plaintiffs filed suit against the Trump administration over their sudden, unlawful revocation of H1B visa status. In their complaint, plaintiffs allege that, without warning on Friday, September 19, 2025, President Trump issued a Proclamation titled “Restriction on Entry of Certain Nonimmigrant Workers”. This Proclamation “restricted” entry into the United States of workers on H1B visas, conditioning it on their employers making a $100,000 “payment” to the federal government, starting less than 36 hours after issuance, at 12:01 am ET on Sunday, September 21, 2025. Plaintiffs believe Defendants’ abrupt imposition of the $100,000 Requirement is unlawful. They maintain that President has no authority to unilaterally alter the comprehensive statutory scheme created by Congress. Most fundamentally, the President has no authority to unilaterally impose fees, taxes or other mechanisms to generate revenue for the United States, nor to dictate how those funds are spent.
