In September 2025, the Department of Education’s Office for Civil Rights (OCR) terminated New York City Public Schools’ (NYCPS) five-year MSAP grants—worth $47 million total across 19 magnet schools serving roughly 7,700 students in predominantly low-income Black and Hispanic neighborhoods. OCR claimed the NYCPS "Guidelines to Support Transgender and Gender-Expansive Students" violated Title IX by allowing students to use facilities and join activities inconsistent with their sex at birth. Plaintiffs filed this case against the Department of Education (ED), theActing Assistant Secretary of Civil Rights, and the Deputy Chief of Staff for Policy and Programs to challenge these determinations. Judge Arun Subramanian is presiding over this case in the Southern District of New York.

Plaintiffs sought to vacate the Department’s discontinuation orders, enjoin enforcement of the new Title IX interpretation or related Executive Orders against NYCPS, and restore its MSAP grants and allow orderly use of carryover funds. The plaintiffs alleged that the grant terminations are unlawful as well as arbitrary and capricious under the Administrative Procedures Act (APA).

On October 16, the plaintiffs moved for an emergency preliminary injunction ordering the government to:

  1.  Rescind their denial of no-cost grant extensions;
  2. Rescind the September 29, 2025 amended Grant Award Notifications; and

  3. Take such other steps as are necessary to enable plaintiff to access and use the carryover funds from Fiscal Year 2025 MSAP grants pending the determination of this action.

The plaintiffs submitted numerous declarations in support of this motion showing that abrupt terminations after the school year had already begun already caused irreparable harm to the schools, teachers, students, parents and caregivers.

The government moved to dismiss the case for lack of jurisdiction on October 30, 2025 alleging that the court lacks subject matter jurisdiction under the Tucker Act. The government referenced recent Supreme cases where the Court held that where a plaintiff seeks the continuation of a grant and the award of grant funding, the dispute is contractual in nature and a federal district court lacks jurisdiction over it.

This case is ongoing.

CONSENT ORDER AND WITHDRAWAL OF MOTION FOR PRELIMINARY INJUNCTION terminating 4 Motion for Order to Show Cause. IT IS HEREBY ORDERED THAT, ON CONSENT OF THE PARTIES: 1. Plaintiff may use, and draw down reimbursements from, all remaining Carryover Funds, for the period beginning October 1, 2025 and ending June 30, 2026, for any permissible expenses or obligations incurred under the grants up to and through June 30, 2026; 2. Defendants will fully cooperate with NYCPS in facilitating the drawdown of Carryover Funds; 3. Plaintiff withdraws its pending motion for a preliminary injunction, without prejudice; 4. Defendants agree to produce the administrative record relevant to the non-continuation of these five grants to NYCPS by November 25, 2025; and 5. The parties agree to proceed by way of expedited summary judgment motion(s) on a schedule to be agreed upon, subject to the permission and availability of the Court.
