Via a series of executive orders issued in 2025, President Trump has claimed the authority to unilaterally levy tariffs on goods imported from “any and every country, at any rate, calculated via any methodology—or mere caprice—immediately, with no notice, or public comment, or phase-in, or delay in implementation.” Invoking his purported authority under the International Emergency Economic Powers Act (“IEEPA”), President Trump has unilaterally issued several tariffs, including “Liberation Day” global 10% tariffs on nearly all countries, and a 145% tariff on Chinese goods.

On October 30, 2025, a coalition of importers and manufacturers filed this lawsuit in the U.S. Court of International Trade against President Donald J. Trump, Commerce Secretary Howard Lutnick, and several import and trade related agencies, challenging the series of recent tariffs. Plaintiffs sought injunctive and declaratory relief to stop the imposition of tariffs by President Trump. The case was assigned to a three-judge panel consisting of Judges Gary S. Katzmann, Timothy M. Reif, and Jane A. Restani.

The plaintiffs argued that these tariffs exceed presidential authority, violate the nondelegation doctrine, and rest on a fabricated “national emergency.” According to the  plaintiffs, IEEPA does not authorize the president to impose tariffs, and no president, aside from President Trump, has used IEEPA to impose tariffs. If IEEPA does grant such power, the President  may only impose tariffs under an “unusual and extraordinary threat” and a “national emergency”; the plaintiffs alleged that President Trump’s reliance on trade deficits to impose tariffs did not rise to this level.

The case is ongoing.
