On October 29, 2025, the State of Colorado filed this constitutional and administrative law complaint challenging President Trump’s decision to relocate U.S. Space Command headquarters from Peterson Space Force Base in Colorado Springs to Huntsville, Alabama. The complaint alleged that Trump retaliated against Colorado for its vote-by-mail election system, violating the Tenth Amendment, Elections Clause, state sovereignty, and separation-of-powers principles. The state also contended that the Defense Department violated 10 U.S.C. § 483, which requires advance notice to Congress before relocating a major military headquarters. Plaintiff sought declaratory and injunctive relief to enjoin Defendants (1) from effectuating a relocation of U.S. Space Command headquarters, and (2) from taking further action to implement the announced change to the U.S. Space Command headquarters location without following the requirements of 10 U.S.C. § 483.
