The State of Colorado, through its Attorney General, alleged that President Trump issued a decision to move the U.S. Space Command from Colorado Springs in order to punish Colorado for allowing eligible voters to vote by mail.  When issuing his decision, the President announced that “[t]he problem I have with Colorado”  is that “they do mail-in voting” and that this “played a big factor” in the decision. According to the plaintiff state, the President has indicated that this action is only the start and that he will order further executive action to coerce Colorado and other States to end mail-in voting. He demanded that States, like Colorado, that allow mail-in voting “must do what the Federal Government, as represented by the President of the United States, tells them, FOR THE GOOD OF OUR COUNTRY, to do.”

Accordingly, the State of Colorado brought this suit under 28 U.S.C. § 2201 and the Administrative Procedures Act (APA), claiming that the President's action were in violation of Tenth Amendment, Elections Clause, State Sovereignty, and separation of powers principles. Colorado sought a declaration that the decision to move Space Command Headquarters is unconstitutional and an order to prevent the relocation of said headquarters. Further, Colorado sought reasonable fees, costs, and expenses, including attorneys’ fees, pursuant to 28 U.S.C. § 2412. Colorado's attorney general filed this case in the District Court of Colorado and it has been assigned to Judge R. Brooke Jackson.

On January 8, 2026, the State of Colorado filed a much lengthier amended complaint. The plaintiffs added numerous federal defendants, including eight new Cabinet secretaries and their respective departments, while incorporating extensive new factual allegations spanning from May through December 2025 that detailed escalating punitive actions including termination of transportation funding, threats to energy programs, SNAP benefit restrictions, and denial of disaster relief. The legal framework was substantially broadened with the addition of three new causes of action, including claims for equal sovereignty violations, Tenth Amendment Separation of Powers violations, and multiple Administrative Procedure Act challenges, while the requested relief expanded from six to thirteen specific items. The document grew from 21 to 90 pages, reflecting the plaintiffs' updated strategy to frame the dispute as a pattern of unconstitutional federal coercion rather than an isolated policy disagreement.

The state plaintiff then filed a motion seeking a preliminary injunction on January 12, 2026. The state of Colorado alleges that on December 17, 2025, the USDA required Colorado to participate in a forced SNAP "pilot project" mandating recertification of all SNAP households in five counties within 30 days, including in-person interviews with more than 100,000 households. Colorado claims this directive came without advance warning, is logistically impossible to complete, and violates the Administrative Procedure Act and the Constitution's Spending Clause, seeking an injunction to prevent implementation of the recertification requirements. Colorado then sought an expedited briefing schedule for the preliminary injunction. The court granted this motion and ordered an expedited schedule based on Colorado demonstrating there was good cause for speeding up the litigation.

Oral arguments regarding the preliminary injunction were heard before the court on January 28, 2026. As of February 9, 2026, the court has not yet ruled on the matter.

MINUTE ORDER The Court has reviewed the motion for a preliminary injunction and the response. Without commenting on the merits of either partys position at this time, the Courts impression is that the parties have not conferred, and that the parties might benefit from good faith discussion about the recertification process and a more realistic timeframe. Accordingly, the Court tentatively sets oral argument at 9:00 a.m. on January 28, 2026. The Court directs counsel for the parties to confer over the weekend, in person or by video teleconference, with the goal of negotiating a more practical timeframe for recertification and other details of the process. The parties are directed to inform the court by January 27, 2026, and preferably sooner, whether they have reached an agreement that would render the need for a hearing and a possible preliminary injunction moot. ORDER granting 59 Motion for Reconsideration. Granted because the Court does not have the time to continue the back and forth with the plaintiff on the issue. Counsel perhaps has overlooked that its task is not just to make a record for appeal, nor does the length of a reply brief affect its record. The task is to persuade the court to do something. A shotgun motion that raises all possible arguments is not necessarily persuasive. A lengthy reply brief filed when the Court is attempting to study the unnecessarily long motion and reply and to provide a decision on a very short timeframe is not persuasive.
