On March 7, 2025, President Trump issued an Executive Order titled “Restoring Public Service Loan Forgiveness", stating that “individuals employed by organizations whose activities have a substantial illegal purpose shall not be eligible for public service loan forgiveness.” The policy aimed to end the “subsidization of illegal activities, including illegal immigration, human smuggling, child trafficking, pervasive damage to public property, and disruption of the public order, which threaten the security and stability of the United States.” The executive order specifically cited immigration law, terrorism or obstruction of government policy, gender affirming care to minors or other support for transgender children, illegal discrimination, and violations of state tort law. On October 31, 2025, the Department of Education promulgated a Final Rule to disqualify such employers.

On November 3, the plaintiffs – a group of cities and counties, 501(c)(3) nonprofit organizations, and associations representing public service workers – filed this lawsuit against the Department of Education and the U.S. Secretary of Education, in the United States District Court for the District of Massachusetts. Represented by the Democracy Forward Foundation and Protect Borrowers, the plaintiffs alleged that the Secretary violated the Administrative Procedure Act (APA) by issuing a rule that was contrary to and in excess of their statutory authority under the Higher Education Act, that was arbitrary and capricious, that was contrary to the right to free speech, and that was void for vagueness. The plaintiffs sought declaratory and injunctive relief and vacatur of the final rule. The case was assigned to District Judge Myong J. Joun.

On February 10, 2026, the plaintiffs filed an amended complaint which added additional plaintiffs, including labor unions and professional associations, and strengthened its claims that the Department’s Final Rule violated the First Amendment.

The plaintiffs moved for summary judgment on all claims on February 12, 2026. The plaintiffs maintained that they had standing and that the final rule was unlawful under the APA. The plaintiffs argued that they had demonstrated particularized injuries that arose from the final rule, including compliance costs, competitive disadvantage, and reputation harm. The plaintiffs further contended that the final rule exceeded the statutory authority granted to the Department under the Higher Education Act. The plaintiffs also argued that the final rule violated the First Amendment because it imposed viewpoint discriminatory restrictions on the PSLF program.

On March 16, 2026, the defendants filed a cross-motion to dismiss the case, or, in the alternative, for summary judgment. The defendants argued that the plaintiffs could not satisfy standing and ripeness requirements because their alleged harms were based on speculation, rather than actual or imminent harm. The defendants also posited that the plaintiffs would not succeed on the merits because the Department had the authority to issue the final rule, and it it targeted illegal conduct, not protected speech.

The court held a hearing on June 3, 2026 on the parties' motion for summary judgment and motion to dismiss. Following this hearing, on June 30, 2026, the court ruled that the Department’s final rule was unlawful and vacated it, holding that the final rule was contrary to the law and in excess of statutory authority. 2026 WL 1876366. The court explained that 20 U.S.C. §1082(a)(1), the statute upon which the defendants relied in supporting the rule only delegates rulemaking authority with respect to the Federal Family Education Loan (FFEL) program, not PSFL. The court held that the other statutes the defendants relied upon only provided the Secretary with general discretionary authority, not the specific authority needed to revise the definition of a public service job or impose eligibility requirements beyond what Congress had prescribed. The court further held that the final rule was arbitrary and capricious because: (1) the Department failed to establish a rational connection with its decision to issue the final rule and an actual, identifiable problem, (2) the final rule was vague and ambiguous, which did not allow employers to understand its duties under the rule, and (3) it relied on impermissible factors that deviated from Congress’ definition of “public service job”. Lastly, the court held that the final order violated the First Amendment because it constituted unlawful viewpoint discrimination by tying loan forgiveness to whether an employer’s work aligned with the Administration’s policy priorities.
