This case challenged the Massachusetts Institute of Technology (MIT) for allegedly permitting and failing to prevent and address pervasive antisemitism on its campus, particularly after the October 7 attacks, in violation of federal and state law. On February 7, 2024, StandWithUs Center for Legal Justice (SCLJ), three SCLJ members, and two Jewish students enrolled at MIT filed this lawsuit in the U.S. District Court for the District of Massachusetts against MIT. According to the plaintiffs, MIT permitted pro-Palestinian protests and other actions on campus that contributed to Jewish and Israeli students feeling harassed, unsafe, or excluded. The plaintiffs brought a claim under Title VI of the Civil Rights Act of 1964, and sought injunctive relief, damages, and attorneys’ fees. This case was assigned to Judge Richard G. Stearns.

In their complaint, the plaintiffs alleged that MIT violated Title VI by acting with deliberate indifference to severe and pervasive antisemitic and anti-Israeli harassment, creating a hostile educational environment for Jewish and Israeli students. They further claimed that MIT failed to act or applied its policies with leniency or delay when known or reported incidents involved antisemitism.

On February 18, 2024, MIT moved to dismiss the lawsuit for failure to state a claim and for lack of subject matter jurisdiction.

The plaintiffs filed an amended complaint on May 17, 2024. The revised complaint added claims under 42 U.S.C. § 1986 (failure to prevent a conspiracy to interfere with civil rights), negligence, and breach of contract, and sought to convert the case into a class action on behalf of all Jewish and/or Israeli students enrolled at MIT after October 7, 2023, who did not participate in pro-Palestinian protests.

In light of the amended complaint, the February 18 motion to dismiss was rendered moot. Accordingly, MIT filed a motion to dismiss the revised complaint on June 14, 2024.

On July 30, 2024, the court denied MIT’s motion to dismiss for lack of standing but granted its motion to dismiss for failure to state a claim. The court found that students had standing to seek prospective injunctive relief. However, the court determined that the complaint did not plausibly allege deliberate indifference under Title VI, as MIT’s response to campus protests was not clearly unreasonable given the circumstances, and MIT took steps to address escalating incidents. The § 1986 conspiracy claim was also dismissed, as the plaintiffs did not adequately allege a conspiratorial agreement to deprive them of civil rights. After dismissing all federal claims, the court declined to hear the remaining state-law negligence and breach of contract claims. 742 F. Supp. 3d 133. Accordingly, the case was formally dismissed by order entered on August 21, 2024.

On October 21, 2025, the U.S. Court of Appeals for the First Circuit upheld the lower court’s decision. The appellate court found that most of the challenged actions were protected by the First Amendment as free speech on matters of public concern, and did not qualify as harassment under Title VI. The court rejected the plaintiffs’ argument that MIT lost its right to allow such speech by accepting federal funds and concluded the protests as a whole did not amount to race-based harassment under Title VI. The court also determined that the alleged antisemitic incidents were isolated, not severe or widespread enough, and not thoroughly reported to show a systemic denial of access to education. Additionally, it found MIT was not deliberately indifferent. The claim under § 1986 failed because there was no plausible evidence of a conspiracy. With all federal claims dismissed, the court also supported the decision not to consider the remaining state-law claims or allow further amendment of the complaint. 158 F.4th 1.

The plaintiffs filed a petition for rehearing en banc on November 25, 2025. On January 1, 2026, the Court of Appeals denied the petition because a majority of the active judges did not vote to rehear the case. Judge Dulap, concurring in the denial, also concluded that the circumstances did not meet the high standard required for full-court review.
