On April 16, 2024, a Jewish-Hispanic student at Columbia filed this lawsuit in the U.S. District Court for the Southern District of New York against Columbia. The plaintiff brought claims under Title VI of the Civil Rights Act of 1964, New York Executive Law § 296, New York Civil Rights Law § 40, N.Y.C. Administrative Code § 8-107, and breach of contract. The plaintiff sought injunctive relief reversing and expunging the disciplinary findings and sanctions, as well as damages and attorneys’ fees. The case was assigned to Judge Jesse M. Furman. 

In the complaint, the plaintiff alleged that Columbia intentionally discriminated against him as a Jewish and Israeli student by disciplining him for expressing opposition to a pro-Palestine rally, specifically by spraying a non-toxic “fart” spray into the air, while failing to sanction students who organized and participated in the unsanctioned rally. The plaintiff claimed this constituted the creation of a hostile educational environment in violation of Title VI. He further alleged that Columbia’s failure to ensure an educational environment free from harassment and discrimination, and its inadequate response to antisemitic harassment on campus, violated New York law. Additionally, the plaintiff alleged that Columbia breached its express and implied promises (including the duty of good faith and fair dealing) to provide a campus free of discrimination and to fairly enforce disciplinary and freedom-of-expression policies, instead applying these policies selectively to his detriment.

On April 16, 2024, the plaintiff filed an ex parte motion seeking leave to proceed under the pseudonym “John Doe,” to identify certain non-parties by pseudonym, and to prohibit Columbia from publicly identifying him. The court temporarily granted the request as to the plaintiff’s anonymity and denied the request as to non-parties without prejudice. 

On July 31, 2024, the court dismissed the case following a settlement, with the dismissal subject to reopening within 60 days if the settlement is not consummated. The terms of the settlement have not been publicly disclosed. 

This case is now closed.

ORDER granting in part and denying in part 4 Motion re: 4 MOTION Proceed under Pseudonym and to Issue a Protective Order . On April 16, 2024, Plaintiff in this case filed a motion seeking an order (1) authorizing him to file the Complaint, summons, and civil cover sheet in this action using the pseudonym John Doe, and to file all other papers in this action under the name John Doe, and to identify other non-parties by pseudonym; and (2) prohibiting Defendants from publicly identifying Plaintiff, in court filings or otherwise. That motion is DENIED as to non-parties, albeit without prejudice to a future application in the event that either party believes that there is a need or basis to prevent disclosure of the identity of any specific non-party. The motion is otherwise GRANTED, but only temporarily. Defendant and any non-party who seeks, and is granted, leave to intervene for purposes of being heard on the issue shall file any opposition to the motion within two weeks of Defendants entering a notice of appearance; any reply shall be filed within one week of any opposition. In the meantime, the Court reserves judgment on whether to grant the motion on a more permanent basis. Finally, to ensure that the Court has no conflicts that would require recusal, Plaintiff shall promptly file, under seal, a declaration disclosing his identity to the Court.
