On May 26, 2024, a Jewish student at the University of Nevada, Las Vegas (UNLV) filed this lawsuit in the U.S. District Court for the District of Nevada. The plaintiff sued UNLV, UNLV’s president in both his individual and official capacities, the Nevada System of Higher Education (NSHE), and several pro-Palestinian organizations, asserting violations of the First Amendment, Anti-Terrorism Act, Equal Protection Clause, Title VI of the Civil Rights Act, 42 U.S.C. §1983 for failure to train and ratification, along with claims of intentional infliction of emotional distress and negligent hiring, and negligent retention and supervision. The plaintiff alleged that the defendants fostered a hostile environment for Jewish students following the October 7, 2023, Hamas attacks, with student and non-student groups acting as proxies for foreign terrorist organizations to incite violence, disseminate antisemitic propaganda, and harass Jewish students. He further alleged that UNLV administrators were deliberately indifferent to repeated complaints of antisemitic conduct, including protests, vandalism, and harassment, and failed to address the discrimination faced by Jewish students. The plaintiff sought declaratory and injunctive relief barring organizations that violate the NSHE’s student conduct code from engaging in any campus activities, damages, and attorney's fees. The case was assigned to District Judge Andrew P. Gordon.

On August 9, 2024, the plaintiff filed an amended complaint, strengthening his factual allegations.

On September 18, 2024, UNLV’s president filed a motion to dismiss for insufficient service of process, while asserting immunity under the Eleventh Amendment for claims brought in his official capacity and qualified immunity.

On October 8, 2024, AJP Educational Foundation (AJP) filed a motion to dismiss for failure to state a claim, lack of personal jurisdiction, and insufficient service of process. It argued that the plaintiff failed to allege personal harm by an act of international terrorism and that it did not engage in extreme and outrageous conduct with the intention of, or reckless disregard for, causing emotional distress.

On November 12, 2024, UNLV filed a motion to dismiss, arguing lack of standing, insufficient service of process, failure to state a claim, and Eleventh Amendment immunity.

On November 18, 2024, AJP filed a special motion to dismiss the plaintiff’s intentional infliction of emotional distress (IIED) pursuant to Nevada’s anti-SLAPP statute. It argued that since the plaintiff’s IIED claim was based entirely on good faith communications in furtherance of the right to free speech, the claim violated the statute.

On March 5, 2025, Students for Justice in Palestine UNLV (SJP UNLV) filed a motion to dismiss for failure to state a claim. It argued that the plaintiff’s claims were barred by the First Amendment, that the plaintiff failed to adequately allege that SJP UNLV’s actions were extreme and outrageous, and that the plaintiff failed to adequately allege that SJP UNLV knowingly aided and abetted any act of international terrorism.

On March 27, 2025, a professor named as a defendant for his involvement with AJP filed a motion to quash or strike service for failure to properly serve him, along with a request for attorney's fees and costs. The defendant argued that the plaintiff served him as a representative of National Students for Justice in Palestine (NSJP) even though he had never been affiliated with the organization.

On April 11, 2025, SJP UNLV filed a special motion to dismiss the plaintiff’s IIED claim against it pursuant to Nevada’s anti-SLAPP statute, and also moved for attorney’s fees and other costs under that statute.

On April 24, 2025, the court granted the professor’s motion to quash, holding that the plaintiff had not opposed the motion, which constituted a consent to the granting of the motion. That same day, the plaintiff filed a motion for reconsideration of the court’s order. He argued that the court was unaware of an agreed-upon extension between the parties regarding his response to the motion to quash.

On May 5, 2025, the court partially granted AJP’s motion to dismiss, dismissing all claims against it for lack of personal jurisdiction, including the Anti-Terrorism Act claims, without prejudice. The court also granted SJP UNLV’s motion to dismiss, dismissing the Anti-Terrorism Act claims without prejudice. The court further granted both AJP and SJP UNLV’s special motions to dismiss, dismissing the IIED claims with prejudice. Judge Gordon held that the plaintiff failed to plausibly allege an injury arising from international terrorism or substantial assistance to Hamas. The court also concluded that the defendants’ conduct was protected by the First Amendment and that the plaintiff did not demonstrate a probability of prevailing under Nevada’s anti-SLAPP statute. The plaintiff was granted leave to amend the complaint by June 3, 2025, to address the identified deficiencies. 2025 WL 1294107.

That same day, the court granted the UNLV president’s motion to dismiss, finding that service of process was insufficient and that the plaintiff failed to state a claim. Judge Gordon dismissed Anti-Terrorism Act and Title VII claims with prejudice, holding that the UNLV president was not a proper defendant. The court also dismissed claims brought under Title VI and 42 U.S.C. § 1983 without prejudice, finding that the plaintiff sued for damages instead of prospective injunctive relief. The court also partially granted the Board of Regents of the NSHE’s motion to dismiss, dismissing several claims against UNLV with prejudice due to Eleventh Amendment immunity, except for claims under Title VI and Title VII of the Civil Rights Act, which were allowed to proceed. The plaintiff was granted leave to amend the complaint by June 3, 2025, to address the identified deficiencies. 2025 WL 1311037.

On May 19, 2025, both AJP and SJP UNLV filed motions for attorney’s fees and other costs.

On June 3, 2025, the plaintiff filed a second amended complaint, adding UNLV’s interim president as a defendant and strengthening factual allegations.

On July 3, 2025, the court granted the plaintiff’s motion for reconsideration of the court’s April 24 order granting the professor’s motion to quash. The court found that the plaintiff's failure to file a stipulation was the result of excusable neglect due to a change in counsel, and that reconsideration would not prejudice the defendant. The plaintiff was ordered to file an opposition to the motion to quash by July 7, 2025.

On August 1, 2025, both AJP and SJP UNLV filed motions to dismiss. AJP argued that the plaintiff failed to plead facts sufficient to establish personal jurisdiction and failed to state a claim. It asserted that the plaintiff failed to allege personal harm by an act of international terrorism and failed to allege that AJP had substantially assisted Hamas. SJP argued that the plaintiff's claims were barred by the First Amendment and that the plaintiff failed to allege that SJP UNLV knowingly aided and abetted an act of international terrorism.

On August 4, 2025, both AJP and SJP UNLV filed special motions to dismiss pursuant to Nevada’s anti-SLAPP statute. They argued that the communications at issue were entitled to statutory protection because they fell under good faith communications in furtherance of the right to free speech and involved an issue of public concern.

On September 2, 2025, UNLV’s interim president and UNLV filed a motion to dismiss for failure to state a claim. They argued that the plaintiff retained inflammatory and irrelevant material that the court had previously instructed him to omit from an amended filing, which resulted in a failure to assert legally sufficient claims.

On April 3, 2026, the plaintiff and some of the defendants filed a stipulation and proposed order. The plaintiff agreed to dismiss all claims with prejudice against AJP asserted in his second amended complaint. AJP agreed to withdraw with prejudice its motion for attorney’s fees and costs, along with its motion to dismiss. The professor-defendant also agreed to withdraw his motion to quash with prejudice, and the plaintiff agreed to withdraw his claim of service on the professor-defendant. Three days later, the court granted the parties’ stipulation.

This case is ongoing.
