This is a lawsuit challenging the refusal of ICE to permit religious leaders to offer Holy Communion and prayer at an immigration detention facility.

On November 19, 2025, the Coalition for Spiritual and Public Leadership, a religious advocacy group, and several individual religious leaders, sued the U.S. Department of Homeland Security (DHS), the U.S. Department of Justice, and President Trump in the U.S. District Court for the Northern District of Illinois.  They challenged the denial of permission to minister at the U.S. Immigration and Customs Enforcement (“ICE”) facility in Broadview, Illinois as a violation of their Free Exercise rights under the First Amendment, and asserted that right as well on behalf of the detainees who would have participated in the religious services. They further challenged the denial, for unspecified "safety and security concerns," under the Religious Freedom Restoration Act of 1993 (“RFRA”) and the Religious Land Use and Institutionalized Persons Act of 2000 (“RLUIPA”). Plaintiffs sought declaratory and injunctive relief, including that the court enjoin defendants from denying plaintiffs access to minister to detainees at the Broadview facility, including for religious services, praying, pastoral care, and ministering sacraments, except under reasonable rules and regulations.  The case was assigned to Judge Robert W. Gettleman. 

On December 5, 2025, the plaintiffs moved for a preliminary injunction to restore immediate access for prayer, pastoral care, and the distribution of Communion. They asserted that the continued restriction constituted religious discrimination without cause in violation of the First Amendment and risked irreparable harm to both clergy and detainees by way of immense spiritual deprivation. 

On February 12, 2026, Judge Gettleman granted plaintiffs' preliminary injunction motion after finding that defendants have substantially burdened the plaintiffs' free exercise of religion. In addition, the court directed both parties to establish a safety protocol for Ash Wednesday Services. 2026 WL 396349. 

Plaintiffs, on March 23, 2026, filed a renewed motion for supplemental injunctive relief to allow access to Broadview for religious services during Holy Week (April 2 to April 5). The court granted the supplemental preliminary injunction against defendants on March 31, relying largely on the same reasoning in the preliminary injunction that granted access to Broadview for Ash Wednesday. 

After a series of granted supplemental preliminary injunctions issued ahead of religious holidays, Judge Middleman the considered plaintiffs' motion that defendants allow plaintiffs daily access to Broadview while this case was pending. On April 7, 2026, Judge Middleman granted plaintiffs' motion for a preliminary injunction, finding that defendants' blanket denial of clergy visits to Broadview violates RFRA. The court enjoined defendants from enforcing a total ban on clergy-initiated visits to Broadview, and directed defendants to allow plaintiffs daily access to Broadview.

This case is ongoing.

SUPPLEMENTAL ORDER: In light of the parties' representations at the hearing conducted this afternoon, in addition to the terms of this court's order of earlier this date (Doc. 26), the court further orders that: 1. The visit on Ash Wednesday, February 18, 2026, will take place in a space sufficient for the distribution of Communion and ashes. 2. The visit will occur at a time agreed to by the parties. 3. No more than four visitors may attend on behalf of plaintiffs, absent agreement of the parties. 4. Plaintiffs will provide defendants with 24-hour notice of the identity of the four individuals who will visit the Broadview facility on Ash Wednesday. 5. Plaintiffs' visitors shall be afforded the opportunity to briefly address the detainees as a group in order to explain their role and invite detainees to participate in Ash Wednesday services. 6. No detainee will be required to participate in Ash Wednesday services. 7.Plaintiffs' visitors will be required to undergo standard background check, ID verification, and usual security protocol for visiting the facility. 8. Plaintiffs' visit should preserve Immigration and Customs Enforcement's ("ICE") ability to implement security measures so as to avoid interference with facility operations and with operational parameters reasonably determined by ICE. PRELIMINARY INJUNCTION ORDER signed by the Honorable Robert W. Gettleman on 3/31/2026: The court orders the following: 1. Defendants are directed to allow plaintiffs to access the Broadview facility on each day of Holy Week, from Thursday April 2, 2026, through Sunday April 5, 2026, to offer services for those who desire them. 2. The parties are directed to meet and confer to establish an appropriate protocol for the purposes of safety and security with regard to the Holy Week services. 3. Based on the parties' representations during today's proceedings, the court directs them to meet and confer with regard to plaintiffs' religious ministry at the Broadview facility after Holy Week, including: (1) personal interactions between plaintiffs and detainees; and (2) the ability of plaintiffs to engage in prayer outside of the Broadview facility and in view of the detainees. 4. The visits on Holy Week will take place in a space sufficient for services. 5. The visits will occur at a time agreed to by the parties. 6. No more than four visitors may attend on behalf of plaintiffs, absent agreement of the parties. 7. Plaintiffs will provide defendants with 24-hour notice of the identity of the four individuals who will visit the Broadview facility on Holy Week. 8. Plaintiffs' visitors shall be afforded the opportunity to briefly address the detainees as a group in order to explain their role and invite detainees to participate in Holy Week services. 9. No detainee will be required to participate in Holy Week services. 10. Plaintiffs' visitors will be required to undergo standard background check, ID verification, and usual security protocol for visiting the facility. 11. Plaintiffs' visits should preserve Immigration and Customs Enforcement's ("ICE") ability to implement security measures so as to avoid interference with facility operations and with operational parameters reasonably determined by ICE. 12.
