This is a case challenging a university’s response to pro-Palestine protests. On February 3, 2025, five students, alumni, and community members who participated in pro-Palestine protests at the University of Michigan filed this lawsuit in the U.S. District Court for the Eastern District of Michigan in the Southern Division. The plaintiffs sued four university officials in their official capacities, including the President and Chief of Police, asserting First and Fourteenth Amendment violations.…

This is a case challenging a university’s response to pro-Palestine protests.

On February 3, 2025, five students, alumni, and community members who participated in pro-Palestine protests at the University of Michigan filed this lawsuit in the U.S. District Court for the Eastern District of Michigan in the Southern Division. The plaintiffs sued four university officials in their official capacities, including the President and Chief of Police, asserting First and Fourteenth Amendment violations. Represented by the ACLU, the plaintiffs alleged that the defendants disproportionately targeted pro-Palestine protesters through arrests, detentions, and trespass bans despite a history of civil disobedience on campus. They further alleged that this response chilled free speech. The plaintiffs sought declaratory and injunctive relief barring the defendants from enforcing the trespass bans that were issued against them and any future trespass bans, along with attorney’s fees. The case was assigned to District Judge Mark A. Goldsmith.

On February 3, 2025, the plaintiffs filed a motion for a preliminary injunction prohibiting the defendants from enforcing the trespass bans that were issued against them, and from issuing any future trespass bans. They argued that they were likely to succeed on the merits, that they would suffer irreparable harm absent injunctive relief, and that the public interest would be served through injunctive relief. 

On August 20, 2025, one plaintiff filed a notice of voluntary dismissal. 

On August 27, 2025, the plaintiffs filed an amended complaint, adding two plaintiffs, substituting two defendants, and strengthening their factual allegations.

On September 12, 2025, the court granted the one plaintiff’s voluntary dismissal. The rest of the plaintiffs’ claims were left intact.

On September 29, 2025, the court denied the plaintiffs’ motion for a preliminary injunction. Judge Goldsmith held that the factual record was insufficiently developed to resolve the plaintiffs’ claims and adopted an accelerated case management schedule to facilitate prompt discovery, summary judgment practice, and trial.

On May 8, 2026, the court entered the parties' stipulation of dismissal and amendment of pleadings in which they agreed to dismiss one plaintiff’s claims and allow the rest of the plaintiffs to file a second amended complaint. 

On May 19, 2026, the plaintiffs filed a second amended complaint, strengthening their factual allegations.

This case is ongoing.
