On December 4, 2023, Black and Latino voters in North Carolina filed a federal lawsuit in the U.S. District Court for the Middle District of North Carolina against leaders of the North Carolina General Assembly and the North Carolina State Board of Elections, challenging the state’s newly enacted 2023 congressional redistricting plan. Plaintiffs alleged that the congressional plan violated the U.S. Constitution by intentionally discriminating against minority voters and by unlawfully using race as the predominant factor in drawing Congressional Districts 1, 6, 12, and 14. Specifically, plaintiffs asserted that the General Assembly intentionally packed and cracked Black and Latino voters to dilute their voting strength, dismantled existing minority-opportunity and crossover districts, and entrenched white majority political control, in violation of the Fourteenth Amendment’s Equal Protection Clause and the Fifteenth Amendment. Plaintiffs further alleged that the race-based redistricting failed strict scrutiny and was not narrowly tailored to comply with the Voting Rights Act, but instead weakened minority voters’ ability to elect candidates of their choice. The complaint sought declaratory relief invalidating the challenged districts and the 2023 congressional plan as unconstitutional, injunctive relief barring their use in future elections, and an order requiring the adoption of a lawful congressional map, with judicial intervention if the state failed to enact a valid plan. The case was initially assigned to Judge Loretta C. Biggs, and then reassigned to Judge Thomas D. Schroeder.  

On January 25, 2024, plaintiffs filed a motion to consolidate the case with North Carolina State Conference of NAACP v. Berger, another action challenging the state’s congressional redistricting, for coordinated pretrial proceedings. On March 4, 2024. plaintiffs amended their complaint to add a new count alleging that the 2023 congressional plan violated Section 2 of the Voting Rights Act through intentional vote dilution of Black and Latino voters; a claim also made in the NAACP v. Berger case. On March 18, 2024, the court issued an order consolidating the two cases, as they covered many of the same questions of law, with this lawsuit as the lead case.  The consolidated case was assigned to a three-judge panel comprised of Judge Schroder, Judge Allison Jones Rushing of the U.S. Court of Appeals for the Fourth Circuit, and Chief Judge Richard E. Myers II of the U.S. District Court for the Eastern District of North Carolina.

After months of pretrial motions, on April 8, 2025, the three-judge court issued a memorandum order granting in part and denying in part the Legislative Defendants’ motion for partial summary judgment in the consolidated cases. 2025 WL 1553759. The court dismissed challenges to numerous state House, state Senate, and one congressional district for lack of standing, reasoning that a voter lacks standing to challenge a district where he or she does not reside, and, accordingly, that before the court could exercise jurisdiction over a challenge to any given district, the consolidated plaintiffs needed to identify at least one allegedly injured individual plaintiff or member of an associational plaintiff who resided in that district, which they had done as to some but not all districts. The panel allowed claims to proceed only in districts where plaintiffs identified an injured voter or organizational member. The court also granted summary judgment on the state legislative malapportionment claims, finding that population deviations under 10% were not shown to result from illegitimate districting factors. All other claims were allowed to proceed.  The court denied the NAACP Plaintiffs’ motion to reconsider on June 9, 2025. 2025 WL 1798333. 

After another few months of pretrial motions the parties began to litigate the surviving claims at trial on June 16, 2025. Following the six day bench trial, on November 20, 2025, the court granted defendants’ motion for summary judgement on all remaining challenges to North Carolina’s 2023 congressional and state Senate maps, concluding that plaintiffs failed to prove that the General Assembly acted with discriminatory intent or unlawfully diluted Black voters’ voting strength in violation of the Fourteenth or Fifteenth Amendments or Section 2 of the Voting Rights Act. The court found that the legislature did not use racial data, relied on permissible traditional and partisan districting criteria, and that the evidence did not overcome the presumption of legislative good faith. The court therefore entered partial final judgment and dismissed without prejudice all claims related to the 2023 plan, except for those pertaining to CD 1, as to which it reserved ruling pending the outcome of claims in supplemental complaints related to 2025 adjustments pursuant to S.B. 249. Supplemental claims regarding the 2025 redistricting remained pending. 2025 WL 3240456.   

Although the claims pertaining to the 2025 redistricting are currently still pending, on November 26, 2025, the court denied both motions for a preliminary injunction seeking to block the use of North Carolina’s newly enacted 2025 congressional districts for Districts 1 and 3 in the 2026 election. The court reasoned that plaintiffs failed to make a clear showing that they were likely to succeed on the merits of their constitutional or Voting Rights Act claims, and found insufficient evidence that the legislature acted with discriminatory intent or unlawfully diluted minority voting strength. 2025 WL 3296273. 

As of December 19, 2025, this case is ongoing.

TEXT ORDER issued by JUDGE ALLISON JONES RUSHING, CHIEF JUDGE RICHARD E. MYERS II, and JUDGE THOMAS D. SCHROEDER on 5/1/2024. The court is in receipt of the parties' proposed Rule 26(f) report in these consolidated cases. (Doc. 44 .) In general, the court is inclined to approve it, except to the extent it leaves insufficient time before trial for the court's consideration of any motions for summary judgment and pretrial filings. The parties propose the close of discovery on December 12, 2024, with certain supplemental expert reports to be produced by January 31, 2025, and depositions on the same by February 21, 2025. Summary Judgment motions are due one week later, on February 28, 2025. With 30 days for a response and 14 days for a reply (under the court's local rules), those motions would not be ripe for decision until April 14, 2025. That leaves insufficient time for decision and for Rule 26 pretrial disclosures before the parties' proposed trial date as soon as practicable after May 15, 2025. (Doc. 44 at 5.) With an estimated 10-day trial, it is not feasible for trial to start in May 2025. Trials are ordinarily set 6 to 8 months after the close of discovery, which is usually 4 to 6 months after Rule 56 motions are fully briefed. The court intends to set a trial date in mid-June 2025. The parties are therefore directed to meet and confer by May 14, 2024, and to condense their proposed discovery schedule so as to allow at least 150 days for the court's consideration of the motions for summary judgment before a trial to start in mid-June. Any revised proposed Rule 26(f) report shall be submitted within 10 days of the meet and confer. SO ORDERED, BY THE COURT. (ae)
