This is a challenge to a Missouri referendum on the legislation redrawing the state’s congressional districts, under the Elections Clause and the “independent state legislature” notion.

The Missouri General Assembly, Missouri Secretary of State Denny Hoskins in his official capacity, and the State of Missouri filed suit in the U.S. District Court for the Eastern District of Missouri on October 15, 2025. Defendants were Richard von Glahn and People Not Politicians ("PNP"), a non-profit political and advocacy organization. Plaintiffs were represented by Louis Joseph Capozzi III as Solicitor General and Graham Miller as Deputy Solicitor General of the Missouri Attorney General's Office. Defendants were represented by Jessica Ring Amunson of Jenner and Block LLP and Charles W. Hatfield of Stinson LLP. The case was assigned to the Honorable Zachary M. Bluestone, United States District Judge.

After the passage of a new congressional redistricting bill by the General Assembly, but before the Governor signed it into law, PNP initiated a referendum process by submitting a petition to the Secretary of State on September 12, 2025. PNP secured support and resources from out-of-state partisan special interests, with the Democratic National Committee promising to devote staff and monetary support to the referendum.

The State advanced two causes of action. Under Count 1, the State alleged that PNP's referendum efforts violated the Elections Clause of the U.S. Constitution, Art. I, § 4, cl. 1, which vests in state legislatures by virtue of a direct grant of authority under the United States Constitution, the power to prescribe the times, places, and manner of federal congressional elections. Under Count 2, the State alleged a violation of the Missouri Constitution, Art. III, § 45, arguing that the Missouri Constitution specifically vests the General Assembly with the power to divide the State into congressional districts and that Missouri had not made a deliberate and clear choice to override that authority through the referendum process. The State sought declaratory relief that the proposed referendum was unconstitutional, and temporary, preliminary, and permanent injunctive relief to prevent PNP from continuing to seek a referendum on the redistricting bill.

A Preliminary Injunction Hearing was held before Judge Bluestone on November 25, 2025. The Court heard argument on the State's Motion for Preliminary Injunction and Defendants' Motion to Dismiss. The State argued that any departure from the Elections Clause's vesting of redistricting authority in the legislature required "positive and clear language," that the Missouri Constitution contained no text specifically addressing whether federal redistricting bills are subject to the referendum process, and that the case was categorically ineligible for Pullman abstention because, under Moore v. Harper, the meaning of state law in Elections Clause cases is a federal question. PNP characterized the lawsuit as unprecedented, with a state, a state official, and the General Assembly suing their own citizens to prevent them from petitioning their government, and argued there were many things wrong with the lawsuit: wrong plaintiffs, wrong defendant, wrong timing, and wrong court. PNP further argued there were numerous threshold issues precluding the Court from reaching the merits, including no standing, no ripeness, no cause of action, and no federal question jurisdiction, and that if the merits were reached, the federal claim was foreclosed by a century of Supreme Court precedent reaffirmed in Moore v. Harper.

After considering the parties' arguments, the Court held that the lawsuit was not ripe for adjudication. The State's past injuries, including the cost of processing the referendum petition and litigating state-court cases, were not redressable given that it sought only prospective relief. The State's ongoing injuries during the case, including referendum-processing obligations and litigation expenses, were likewise insufficient to establish standing, as the State had abandoned its ability to prevent these harms when it agreed to forego emergency relief until the hearing. As for the State's anticipated future injuries, the Court found that Secretary Hoskins had the power to declare the petition unconstitutional himself during post-submission review, meaning that decertification would forestall any remaining cognizable harms, and the State's anticipated future injuries were therefore not ripe for adjudication. Accordingly, the Court dismissed the case.

Alternatively, the Court held that even if the case were justiciable, Pullman abstention would be warranted, applying the Eighth Circuit's five-factor test from Beavers v. Arkansas State Board of Dental Examiners. Applying those factors, the Court concluded that abstention was warranted: the State could protect its interests through decertification; the state law was, at a minimum, concededly unclear; a state court determination that the Missouri Constitution did not permit a redistricting referendum would moot the federal constitutional claims; and abstaining would avoid federal interference in a referendum process created entirely by the Missouri Constitution and state law. As to the form of abstention, the Court concluded that dismissal rather than holding the case in abeyance was appropriate, noting that the case would almost certainly be moot by the time a state court lawsuit was filed because decertification would leave the Court with no meaningful relief to grant.

The Court granted Defendants' Motion to Dismiss and denied as moot the State's Motion for a Preliminary Injunction by order dated December 8, 2025.
