Prior to his second term, President Donald J. Trump, a Florida resident, filed a defamation lawsuit against Cable News Network, Inc. (CNN), a Georgia-based corporation, on October 3, 2022, in the United States District Court for the Southern District of Florida. Trump alleged that CNN engaged in a deliberate campaign to defame him by repeatedly using the term "Big Lie" to describe his statements about the 2020 presidential election, which he claimed was intended to associate him with Adolf Hitl…

Prior to his second term, President Donald J. Trump, a Florida resident, filed a defamation lawsuit against Cable News Network, Inc. (CNN), a Georgia-based corporation, on October 3, 2022, in the United States District Court for the Southern District of Florida. Trump alleged that CNN engaged in a deliberate campaign to defame him by repeatedly using the term "Big Lie" to describe his statements about the 2020 presidential election, which he claimed was intended to associate him with Adolf Hitler and Nazi propaganda tactics. The complaint asserted that CNN used this terminology over 7,700 times since January 2021 and employed other inflammatory labels such as "racist," "Russian lackey," "insurrectionist," and "Hitler" to damage Trump politically. While being represented by Lindsey Halligan, Trump brought two counts of defamation, seeking compensatory damages exceeding $75,000, punitive damages of $475 million, and other relief. The case was assigned to Judge Raag Singhal.

On November 22, 2022, CNN moved to dismiss the case for failure to state a claim. CNN argued that Trump's defamation claims based on CNN's use of "Big Lie" in five specific publications failed because the term does not constitute a false statement of fact, represents unverifiable opinion and rhetorical hyperbole protected by the First Amendment, and because Trump failed to plausibly allege actual malice.

Without conducting a hearing, Judge Singhal issued an order granting CNN's motion to dismiss on July 28, 2023. The court ruled that CNN's statements constituted protected political speech under the First Amendment and were opinion rather than actionable factually false statements, finding that terms like "Hitler-like" or "authoritarian" are not verifiable statements of fact due to imprecision in political debate and that the phrase "the Big Lie" does not give rise to a plausible inference that Trump advocates persecution or genocide.

After the court denied Trump's motion to reconsider the dismissal, Trump appealed to the Eleventh Circuit. Following briefing by the parties, on November 18, 2025, the Eleventh Circuit issued an unpublished per curiam opinion affirming the district court's dismissal, holding that Trump failed to adequately plead falsity because CNN's use of "Big Lie" constituted subjective assessment and opinion rather than a false statement of fact, as the term is ambiguous and not readily capable of being proven true or false. The court granted Trump's motion for an extension to file a petition for rehearing.

As of February 8, 2026, Trump has not filed a petition for rehearing and there has been no action taken in the district court.
