This case challenges a Department of Defense policy governing journalists’ access to the Pentagon that conditions press credentials on compliance with vague and discretionary restrictions on lawful newsgathering.

On December 4, 2025, The New York Times Company and its reporter Julian E. Barnes filed this lawsuit in the U.S. District Court for the District of Columbia against the Department of Defense, Secretary of Defense Pete Hegseth, and Pentagon Chief Spokesman Sean Parnell, all sued in their official capacities. The plaintiffs alleged that the Department’s revised Pentagon Facility Alternate Credential (PFAC) policy vested Pentagon officials with unbridled discretion to suspend or revoke journalists’ credentials, in violation of the First Amendment and the Due Process Clause of the Fifth Amendment, and constituted unlawful agency action under the Administrative Procedure Act (APA). The plaintiffs sought declaratory relief, preliminary and permanent injunctive relief, vacatur of the challenged policy provisions, reinstatement of their PFACs, and attorneys’ fees. The case was assigned to District Judge Paul L. Friedman.

On January 5, 2026, the plaintiffs moved for summary judgment, arguing that the PFAC policy was facially unconstitutional and as applied, while being arbitrary and capricious under the APA. The plaintiffs contended that the policy failed to provide fair notice, authorized arbitrary enforcement, and unlawfully restricted access to a nonpublic forum by conditioning Pentagon access on compliance with standardless and discretionary criteria.

The defendants cross-moved for summary judgment on January 30, 2026. 

On March 20, 2026, the court granted the plaintiffs’ motion for summary judgment and denied the defendants’ cross motion. The court determined that the Pentagon's 2025 policy was unconstitutionally vague under the Fifth Amendment. Furthermore, the judge found that the policy violated the First Amendment by facilitating viewpoint discrimination, as leadership used the rules to exclude adversarial "mainstream" reporters while favoring outlets that expressed ideological loyalty to the administration. Undisputed evidence showed that officials openly disparaged traditional journalists as "propagandists" while granting access to political activists who had previously committed federal crimes. Consequently, the court issued a permanent injunction and vacated the challenged provisions, emphasizing that a free press is essential to national security and public accountability. 2026 WL 788689.

On March 24, 2026, the plaintiffs moved to compel the defendants’ compliance with the court’s March 20 order issuing a permanent injunction and vacating the challenged provisions of the policy. The plaintiffs alleged that the defendants defied the court’s order through the release of an “interim” policy. Per the filing, the interim policy bars reporters with press passes from entering the building without an escort, sets up unprecedented rules governing when a reporter can offer anonymity to a source, and leaves in place provisions that the court struck. 

On April 9, 2026, the court granted plaintiffs' motion to compel defendants’ compliance with its prior order. Judge Friedman held that by imposing the provisions of the interim policy, defendants have effectively continued to implement and enforce the PFAC Policy that was subject of the court’s prior order. On April 10, 2026, defendants filed a notice of appeal with respect to the court's March 20, 2026 order on plaintiffs’ motion for summary judgment and the court’s April 9, 2026 order on plaintiffs’ motion to compel compliance. Also, on April 10, 2026, defendants moved in the district court for an immediate stay pending appeal of the challenged orders to the extent that they vacate and enjoin enforcement of the defendants’ escort requirement and closure of the Correspondents’ Corridor. In the alternative, defendants requested a fourteen-day administrative stay of the same court orders to the same extent to allow for orderly briefing in the D.C. Circuit on defendants’ forthcoming stay motion in that court. 

On April 13, 2026, the district court granted in part and denied in part defendants' motion to stay pending appeal, granting the requested fourteen-day administrative stay. On April 13, 2026, defendants filed an emergency motion for stay pending appeal in the Court of Appeals only to the extent that the latest order entitles reporters to access the Pentagon unescorted. The case was assigned to Circuit Judges Justin Walker, Michelle Childs, and Bradley Garcia. Defendants argued that the district court’s permanent injunction and vacatur of the challenged provisions of the PFAC Policy prevented them from carrying out their professional responsibilities of ensuring that the Pentagon is secure and that national security information is protected. 

On April 27, 2026, the Court of Appeals granted defendants’ emergency motion for a stay and ordered that the district court’s April 9, 2026 order be stayed to the extent that it entitles journalists to access the Pentagon unescorted. The court cited the increased risks associated with unescorted access to the Pentagon, which could jeopardize national security. Defendants had permissibly adopted the escort policy as a revised policy in response to an adverse ruling. The escort requirement was not contemplated by the challenged 2025 policy nor had the district court held that it independently violated the First or Fifth Amendment.
