On August 5, 2025, recent Sarah Lawrence graduates and a tenured faculty member filed this lawsuit against Sarah Lawrence and the U.S. House Committee on Education and the Workforce (the Committee) in the U.S. District Court for the Southern District of New York. The plaintiffs brought claims under the First Amendment, Title VI of the Civil Rights Act of 1964 (discrimination and retaliation), the New York Human Rights Law (N.Y. Exec. Law § 290 et seq.), and for breach of contract (Tedeschi rights). The plaintiffs sought a declaratory judgment; an injunction barring the defendants from disclosing any of the plaintiffs’ confidential or FERPA-protected information or engaging in discrimination, retaliation, or censorship based on their protected speech or association; damages; and attorneys’ fees. The case was assigned to Judge Cathy Seibel.

In the complaint, the plaintiffs alleged that the Committee violated the First Amendment by pressuring Sarah Lawrence to suppress pro-Palestinian speech and association, including through broad demands for disciplinary records that chilled speech and invaded associational privacy. They alleged that the Committee engaged in viewpoint discrimination, lacked a legitimate legislative purpose, and was not protected by the Speech or Debate Clause. The plaintiffs also claimed the actions favored certain religious viewpoints, violating the Establishment Clause. They further alleged that Sarah Lawrence, in response, discriminated and retaliated in violation of Title VI and New York law by imposing harsher discipline, enabling surveillance and harassment, and creating a hostile environment targeting pro-Palestinian students and supporters. Finally, they alleged that the college breached its Tedeschi obligations by failing to protect free expression and due process, causing substantial harm.
