Plaintiffs, a group of community members and human rights activists in Eugene, Oregon, had regularly protested the Department of Homeland Security (DHS) Immigration and Customs Enforcement (ICE) outside the ICE office building. Plaintiffs confined their protests to non-federally owned areas. In June 2025, the federal government finalized a new rule to allow DHS to criminalize protests to areas "outside" federal sites. Although the rule was intended to go into effect on January 1, 2026, the federal government announced they would actually go into effect on November 5, 2025 - the same day of announcement. 

Plaintiffs brought suit on December 5, 2025, after a number of them had been threatened and/or arrested by DHS agents for peacefully protesting under the new rule. Seeking declaratory and injunctive relief which would bar the federal government from silencing, detaining, or citing the Eugene ICE protesters, plaintiffs filed suit in the U.S. District Court for the District of Oregon. Plaintiffs alleged that DHS unlawfully promulgated the new anti-protest rule in violation of the Administrative Procedure Act (APA), and unconstitutionally suppressed their right to free speech and assembly under the First Amendment. This case was assigned to U.S. District Judge Ann L. Aiken. 

On December 9, 2025, plaintiffs filed a motion for a temporary restraining order (TRO) to enjoin defendants from arresting and harassing plaintiffs under the "loud or unusual noice" portion of the new federal rule while they protest ICE. Judge Aiken granted the TRO on December 10, 2025, enjoining defendants from enforcing the "loud or unusual noise" provision of 6 CFR § 139.35(c). 2025 WL 3539271.
