This case is an attempt by the United States to obtain a copy of the State of Massachusetts’s unredacted statewide voter registration list, including voter registrants’ full names, dates of birth, addresses, and social security numbers or drivers license numbers. 

On December 11, 2025, The United States brought this lawsuit in the U.S. District Court for the District of Massachusetts against William Galvin, Secretary of the Commonwealth of Massachusetts. The United States’ complaint alleges that in July 2025, the Attorney General sent a letter to Secretary Galvin, seeking information regarding Massachusetts’s compliance with federal election law, and requesting that Galvin send a current electronic copy of the State’s computerized statewide voter registration list. The Secretary’s office did not comply with the letter, and the Attorney General sent a second letter in August 2025, directing the Secretary to disclose the registration list including, voter registrants’ full names, dates of birth, addresses, driver’s license numbers, or the last four digits of their social security numbers. The federal government received no further written correspondence from Secretary Galvin, but was advised by the First Deputy Secretary that the State would not be providing the registration list. The United States alleged that Galvin's failure to furnish specific election records pursuant to 52 U.S.C. § 20703 was in direct violation of the Civil Rights Act of 1960, which imposes a sweeping obligation on election officials to retain and preserve voting records. The federal government claimed authority to request the records under both the National Voter Registration Act (NVRA) and the Help America Vote Act (HAVA), which require States to maintain and preserve certain records and papers that fall within the scope of Section 301 of Title III of the Civil Rights Act. In its complaint, the plaintiff requested that the court compel the defendant to provide the documents requested. 

This case was assigned to District Court Judge Leo T. Sorokin.

On December 12, 2025, the plaintiff filed a motion to compel the defendant to produce Massachusetts's statewide voter registration list within five days if the court grants the motion.  

On December 21, 2025, The New England State Area Conference of the NAACP, and the Massachusetts Alliance for Retired Americans filed a joint motion to intervene as defendants. On December 22, 2025, nonprofits Common Cause and Jane Doe Inc. also moved to intervene, along with an individual Massachusetts voter, as defendants. On January 6, 2026, the court granted each of the interventions. 

On February 6, 2026, the intervenor-defendants moved to dismiss the plaintiff’s complaint for failure to state a claim. 

As of February 28, 2026, the court has not ruled on the intervenor-defendants’ motion.

Pending before the Court are two timely motions to intervene as defendants, either as of right under Rule 24(a) or with permission under Rule 24(b). Doc. Nos. 9, 13. Proposed intervenors are four organizations with Massachusetts-voter members—the New England State Area Conference of the NAACP (Doc. No. 10-1), the Massachusetts Alliance for Retired Americans (Doc. No. 10-2), Common Cause (Doc. No. 15-1), and Jane Doe Inc. (Doc. No. 15-2)—as well as an individual Massachusetts voter, Juan Pablo Jaramillo (Doc. No. 15-3). The existing parties (plaintiff United States and defendant Secretary Galvin) do not oppose the motions to intervene. Doc. No. 9 at 2; Doc. No. 13 at 2. The motions to intervene (Doc. Nos. 9, 13) are therefore ALLOWED as unopposed.Proof of service on defendant Galvin does not yet appear on the docket, and he has not yet responded to the complaint or motion to compel. The Court previously ordered that Galvin’s deadline for responding to the United States’ motion to compel is “21 days after the later of (1) the date of service or (2) the filing on the docket of [the motion to compel].” Doc. No. 8. The intervenor-defendants have indicated their intent to move to dismiss, Doc. No. 9 at 1 n.1; Doc. No. 13-2, and to respond to the motion to compel, Doc. No. 13 at 2. (Some intervenors did not reference the motion to compel but, of course, they may respond as they are now defendants in this case.)The Court intends to adopt a unified briefing schedule. By January 9, 2026, the parties shall file a joint status report that proposes a briefing schedule for (a) the defendants’ responses to the complaint (including any Rule 12 motions), (b) the defendants’ responses to the motion to compel, and (c) the United States’ responses/replies thereto. Any pending responsive pleading deadlines, including those specified in Doc. No. 8, are stayed pending the Court’s adoption of a briefing schedule.
