This case is an attempt by the United States to obtain a copy of the State of Nevada’s unredacted statewide voter registration list, including voter registrants’ full names, dates of birth, addresses, and social security numbers or driver's license numbers.

On December 11, 2025, The United States brought this lawsuit in U.S. District Court for the District of Nevada against the Secretary of State for the State of Nevada, Francisco Aguilar. The complaint alleges that in June, 2025, the Attorney General sent the Secretary a letter requesting, among other information and documents, a description of the State’s verification process under HAVA Section 303(a)(5) that election officials perform to verify the required information supplied by the registrant. The June letter also requested that Nevada provide a current copy of its computerized statewide voter registration list, including both active and inactive voters. The Secretary allegedly responded by providing some of the requested information, but did not include voter registrants’ full names, dates of birth, residential addresses, driver’s license numbers, or social security numbers. The Secretary allegedly refused to provide this information, citing privacy concerns. The federal government alleged that the Secretary’s failure to furnish these records pursuant to 52 U.S.C. § 20703 was in direct violation of the Civil Rights Act of 1960. The federal government claimed authority to request the records under both the National Voter Registration Act (NVRA) and the Help America Vote Act (HAVA), which require States to maintain and preserve certain records and papers that fall within the scope of Section 301 of Title III of the CRA. Through its complaint, and a motion to compel filed the same day, the plaintiff sought the court to compel the defendant to disclose Nevada's full voter registry via court order.

On December 14, 2025, the ACLU of Nevada moved to intervene as a defendant. Then, on December 16, 2025, the NAACP Conference of Idaho, Nevada, and Utah, the Nevada Alliance for Retired Americans, the Institute for a Progressive Nevada, and an individual Nevada voter also moved to intervene as defendants. 

On January 28, 2026, the defendant filed a motion to dismiss the complaint. The defendant argued that the federal government’s request for the unredacted statewide voter registration list violated state and federal privacy laws, including protections for social security and driver’s license numbers. The defendant further argued that the plaintiff failed to provide a valid legal basis for the records under the Civil Rights Act of 1960, arguing that the federal demand was a pretextual attempt to build a centralized national database rather than a legitimate civil rights investigation.
