In this lawsuit, the United States challenges the U.S. Virgin Islands' (USVI) conditions for firearm licensing, alleging that they systematically deprive residents of their Second and Fourth Amendment rights by imposing unconstitutional barriers to gun ownership.

On December 16, 2025, the United States filed suit in the U.S. District Court of the Virgin Islands against the Government of the USVI, the Virgin Islands Police Department (VIPD), and the Police Commissioner (collectively, “USVI”). The complaint alleged that defendants systematically deprived USVI residents of their Second and Fourth Amendment rights by imposing unconstitutional conditions on firearm licensing, including warrantless home searches, mandatory safe installations, and excessive processing delays. Applicants were required to justify their need for firearm ownership by demonstrating they had “good reason to fear death or great injury” to their person or property, needed “two credible persons” to vouch for their need of a firearm, and required “good moral character.” The plaintiff also argued that USVI’s “proper reason” requirement for concealed carry contravened the Supreme Court’s holding in New York State Rifle & Pistol Association v. Bruen. The complaint further asserted that VIPD exercised unchecked discretion in approving licenses, denying permits to applicants deemed to possess "too many" firearms. Finally, the United States argued that severe penalties for unlicensed firearm possession (including a minimum 10-year prison sentence and fines up to $15,000), effectively criminalize the exercise of constitutional rights. The complaint sought declaratory and injunctive relief to prohibit these practices under the Violent Crime Control and Law Enforcement Act of 1994. The case was originally assigned to District Judge Robert A. Molloy but was reassigned to District Judge Evan Rikhye on May 28, 2026. 

On June 10, 2026, the United States filed a motion for a preliminary injunction seeking to prohibit the USVI from enforcing any firearms regulation not explicitly outlined in a USVI statute as well as the “proper reason” requirement in the USVI firearms licensing statute.
