On September 15, 2025, Plaintiffs S.W. and J.S., both minors appearing via their parents and next friends, filed this complaint against Loudoun County School Board in U.S. District Court for the Eastern District of Virginia. In their complaint, Plaintiffs allege their rights have been violated under Free Speech, Equal Protection, Due Process, and Free Exercise of Religion Clauses of the U.S. and Virginia Constitutions, as well as under Title IX of the Education Amendments of 1972 (“Title IX”) and Virginia’s Religious Freedom Restoration Act (“VRFRA”). Plaintiffs allege that Defendant violated each of these provisions of law by intentionally and invidiously discriminating against Plaintiffs, who are Christian boys, after they spoke up against being required to share a locker room with a male transgender student and by punishing them with suspension for their protected speech and religious expression. 

This case is ongoing.

No. 3] is provisionally GRANTED, and it is hereby ORDERED that the Loudoun County School Board immediately place the remainder of S.W.'s 10-day suspension in abeyance, permit S.W. back into school starting on Wednesday, September 17, 2025, and allow him to continue with in-person education until the issues raised in this Complaint are resolved; and it is further ORDERED that counsel for plaintiffs show cause as to why J.S. should not be dismissed from this civil action given that he is no longer attending a Loudoun County public school; and it is further ORDERED that a hearing to determine whether a preliminary injunction should be entered will be held on Friday, September 19, 2025, unless the parties are able to agree to a further abeyance of the suspension while this civil action is fully litigated (see Order for further details).
