This case challenges the Office of Management and Budget’s refusal to apportion congressionally appropriated funds to the Council of the Inspectors General on Integrity and Efficiency (CIGIE), alleging an unlawful effort to dismantle independent oversight of the executive branch.

On December 17, 2025, Public Employees for Environmental Responsibility (PEER), the Government Accountability Project (GAP), and the Project On Government Oversight (POGO) filed this lawsuit in the U.S. District Court for the District of Maryland against the Office of Management and Budget (OMB) and Russell Vought, sued in his official capacity as OMB Director. Plaintiffs alleged that OMB unlawfully withheld and partially apportioned CIGIE’s no-year funds, forcing the shutdown of CIGIE’s operations and impairing its statutory mission to support and oversee federal Offices of Inspector General.

Proceeding under the Administrative Procedure Act, the Anti-Deficiency Act, the Impoundment Control Act, and the U.S. Constitution, plaintiffs claimed that defendants exceeded their statutory authority and acted arbitrarily and capriciously by refusing to make CIGIE’s funds available for obligation. Plaintiffs alleged that OMB’s actions violated separation-of-powers principles by effectively nullifying Congress’s funding decisions and undermined the independence of inspectors general nationwide. They sought declaratory relief, preliminary and permanent injunctive relief requiring OMB to fully apportion CIGIE’s funds for fiscal year 2026, and attorneys’ fees and costs. The case was assigned to District Judge Paula Xinis.
