On December 22, 2025, a coalition of environmental organizations—including Greater Birmingham Alliance to Stop Pollution, Clean Air Council, Sierra Club, and NRDC—filed suit in the U.S. District Court for the District of Columbia against President Donald Trump, the U.S. Environmental Protection Agency (EPA), and EPA Administrator Lee Zeldin.

Plaintiffs challenged a November 2025 presidential proclamation issued under Clean Air Act § 112(i)(4), which exempted all eleven U.S. coke oven facilities from complying with EPA’s 2024 “Coke Ovens Rule,” extending compliance deadlines by two years. Plaintiffs alleged the proclamation exceeded statutory authority because the Clean Air Act permitted exemptions only where required technology was unavailable and where national security justified the exemption—conditions plaintiffs contended were not met and were not supported by facility-specific findings.

The complaint asserted two primary claims. First, plaintiffs brought a nonstatutory ultra vires claim alleging unlawful executive action in violation of the Clean Air Act, arguing that the President misapplied § 112(i)(4) by issuing sweeping, categorical exemptions without the required factual determinations regarding technological infeasibility or national security necessity. Second, plaintiffs alleged that the proclamation exceeded statutory authority because, although framed as an exercise of the exemption power, it operated in substance as a categorical delay of the EPA rule. By uniformly extending all compliance deadlines for all regulated facilities, the proclamation effectively suspended or altered the rule’s requirements—authority that the Clean Air Act assigned to EPA through rulemaking or limited statutory stay provisions, not to the President through § 112(i)(4).

Plaintiffs sought declaratory and injunctive relief invalidating the proclamation and prohibiting its implementation, contending that the exemptions allowed continued emissions of hazardous pollutants such as benzene and mercury and eliminated monitoring and reporting requirements intended to inform affected communities, thereby undermining the public health protections of the Coke Ovens Rule. They also sought an order requiring regulated facilities to comply with the original rule’s deadlines, along with costs and any additional equitable relief the court deemed appropriate.

Following the filing of the complaint, the court issued summons on December 30, 2025, and plaintiffs completed service on all federal defendants by January 16, 2026, triggering a response deadline of February 28, 2026.

On January 27, 2026, industry groups—the American Coke and Coal Chemicals Institute and the Coke Oven Environmental Task Force—moved to intervene as defendants, followed by a similar motion by SunCoke Energy, Inc. on February 5, 2026.

On February 26, 2026, defendants moved to consolidate this case with related challenges and to hold this case in abeyance. The following day, February 27, 2026, plaintiffs filed a motion for summary judgment.

On March 2, 2026, the court stayed dispositive briefing pending resolution of the consolidation motion and struck plaintiffs’ summary judgment motion without prejudice.

On March 6, 2026, an intervenor-applicant and plaintiffs filed responses opposing defendants’ motion to consolidate. Defendants filed a reply in support of consolidation on March 13, 2026.

After a hearing on March 17, 2026, the court granted in part defendants’ motion to consolidate, consolidating this case with three related actions for purposes of resolving common threshold legal questions and designating Texas Environmental Justice Advocacy Services v. Trump as the lead case. The court ordered that all subsequent filings be made in the lead case and set a consolidated briefing schedule for motions to dismiss and summary judgment.

On April 1, 2026, the case was reassigned to Judge Paul L. Friedman following consolidation.

The case remains ongoing.

MINUTE ORDER: Defendants' 43 Motion to Consolidate Cases, Designate Lead Case, and Place Remaining Cases in Abeyance is GRANTED in part and DENIED in part. Pursuant to Federal Rule of Civil Procedure 42(a) and Local Civil Rule 40.5, the Court hereby consolidates Case Nos. 25-cv-3745, 25-cv-4469, 26-cv-233, and 26-cv-287 for the purpose of resolving common threshold legal questions raised by the four cases. All motions, briefs, or other papers related to the consolidated cases shall be filed in the lead case under the caption Texas Environmental Justice Advocacy Services, et al., v. Donald Trump, et al. in Case No. 25-cv-3745. The parties are advised NOT to elect the SPREAD TEXT option when filing in ECF, as this will result in repetitive docketing.In light of this consolidation, the briefing schedule set forth in the February 10, 2026 Minute Order in Case No. 25-cv-3745 is modified as follows: Plaintiffs in Case Nos. 25-cv-4469, 26-cv-233, and 26-cv-287 are directed to file a consolidated response in opposition to Sections 1 and 2 of Defendants' Motion to Dismiss by April 10, 2026. The consolidated brief shall not exceed 30 pages in length. Defendants are directed to file a combined reply in support of their Motion to Dismiss (responding to all Plaintiffs) and response in opposition to the pending Cross-Motion for Summary Judgment by May 8, 2026.
