On December 23, 2025, RENEW Northeast, Alliance for Clean Energy New York, Renewable Northwest, Southern Renewable Energy Association, Interwest Energy Alliance, Mid-Atlantic Renewable Energy Coalition Action, Clean Grid Alliance, and the Carolinas Clean Energy Business Association filed this lawsuit in the U.S. District Court for the District of Massachusetts against the U.S. Department of the Interior, Secretary Douglas Burgum, the Bureau of Land Management, the Bureau of Ocean Energy Management, the Bureau of Safety and Environmental Enforcement, the U.S. Fish and Wildlife Service, the U.S. Army Corps of Engineers, and related officials in their official capacities.

According to the complaint, the challenged actions consisted of six separate agency measures that collectively altered the federal permitting landscape for wind and solar projects. These included: a Department of the Interior memorandum requiring senior-level review of most wind and solar permitting decisions; a departmental order directing agencies to apply a new “capacity density” metric when evaluating projects on federal lands and offshore areas; a related memorandum by the Army Corps of Engineers that used a similar metric to deprioritize renewable energy permits under federal environmental statutes; a Fish and Wildlife Service policy effectively barring the issuance of permits for incidental impacts on eagles from wind projects; a restriction on wind and solar developers’ access to a federal wildlife planning database used to assess environmental impacts; and a legal opinion reinterpreting federal offshore energy law in a way that, according to plaintiffs, significantly limited approval of offshore wind projects. Plaintiffs alleged that these actions departed from longstanding federal permitting practices and imposed new criteria and procedural hurdles that disproportionately burdened renewable energy projects.

The complaint alleged that these agency actions conflicted with multiple federal statutory schemes governing public lands, environmental review, and offshore energy development, including statutes that plaintiffs contended were designed to facilitate efficient permitting and development of energy infrastructure. Plaintiffs asserted that, taken together, the challenged measures disrupted the uniform administration of federal permitting programs, introduced new substantive criteria not found in governing statutes, and undermined reliance interests formed under prior regulatory regimes. They further alleged that the policies had caused concrete harms by delaying approvals, increasing development costs, jeopardizing financing and contractual commitments, and threatening the viability of existing and planned renewable energy projects.

Plaintiffs brought six causes of action under the Administrative Procedure Act, with each count directed at one of the six challenged agency actions. Across these claims, plaintiffs alleged that the actions constituted final agency action that was arbitrary and capricious, contrary to law, and in excess of statutory authority because the agencies failed to provide reasoned explanations for departing from prior policy, relied on factors not authorized by Congress, and treated renewable energy projects differently from other forms of development without justification. Plaintiffs further alleged that several of the actions were procedurally invalid because they effectively established binding rules without undergoing required notice-and-comment rulemaking. In addition, the complaint asserted that certain actions resulted in unreasonable delay in permitting decisions and improperly interfered with statutory mandates governing energy development and environmental review.

The complaint sought broad equitable relief corresponding to these claims. Plaintiffs requested a declaration that each of the six challenged actions violated the Administrative Procedure Act and applicable federal statutes. They further sought an order vacating and setting aside those actions in their entirety, as well as preliminary and permanent injunctions prohibiting defendants from implementing or enforcing the challenged policies. Plaintiffs also requested that the court restore prior permitting practices to the extent necessary to remedy the alleged harms, along with an award of attorneys’ fees, costs, and any other relief the court deemed appropriate.

Following the filing of the complaint, the case was reassigned to Chief District Judge Denise J. Casper on December 29, 2025, after the court determined it was not related to a separate pending case.

On January 12, 2026, plaintiffs filed an amended complaint and moved for a preliminary injunction seeking to enjoin the challenged agency actions. The amended complaint expanded the case while preserving its core challenge to the agencies’ alleged obstruction of renewable energy development. It added a new plaintiff—Green Energy Consumers Alliance, Inc.—and incorporated additional factual allegations further detailing the agencies’ coordinated conduct and its effects on energy projects and markets. It also supplemented the pleading with numerous exhibits and additional support for the existing APA and statutory claims, rather than introducing new causes of action or legal theories. Although the amended complaint refined and strengthened the allegations, it did not materially alter the underlying claims or the scope of relief sought, which continued to focus on declaratory and injunctive relief against the challenged agency actions.

Between January 16 and February 20, 2026, multiple states and environmental and advocacy organizations sought and were granted leave to file amicus briefs in support of plaintiffs’ motion for preliminary injunction.

On February 10, 2026, defendants filed an opposition to plaintiffs’ motion for preliminary injunction. The next day, on February 11, 2026, the court set a hearing on the motion for preliminary injunction for March 4, 2026.

On February 20, 2026, plaintiffs filed a supplemental memorandum and additional declarations in support of their motion for preliminary injunction.

On March 4, 2026, the court held a hearing on plaintiffs’ motion for preliminary injunction and took the motion under advisement.

Shortly thereafter, on March 16, 2026, defendants moved to dismiss the amended complaint for failure to state a claim.

On March 24, 2026, plaintiffs filed an opposition to defendants’ motion to dismiss.

On April 21, 2026, the court granted plaintiffs’ motion for a preliminary injunction as to five of the challenged agency actions, finding plaintiffs likely to succeed on their APA claims (particularly that several actions were contrary to law), that they faced irreparable economic harm from permitting delays, and that the equities and public interest favored relief. 2026 WL 1078282. The court rejected defendants’ standing and redressability arguments, concluding that the challenged review procedures were causing concrete delays and that an injunction would alleviate those harms. However, the court denied relief as to one of the six challenged agency actions (the Department of the Interior Land Order), holding plaintiffs had not shown a likelihood of success on their arbitrary-and-capricious claim at this stage, particularly regarding reliance interests and the adequacy of the agency’s reasoning. The injunction therefore applied only to the five agency actions (not the Land Order), required no bond, and was limited to the plaintiff entities.

The case remains ongoing.
