The American Academy of Pediatrics (AAP) is the “nation’s preeminent professional organization for child health,” and works to “improv[e] the health of children, including through furnishing pediatricians and families with accurate, scientifically supported information.” Under the second Trump administration, AAP was a “sharp” critic of the U.S. Department of Health and Human Services’ (HHS) views on high-profile health policy issues, including gender-affirming care and changes made to the CDC’s vaccination recommendations that were implemented at the direction of HHS Secretary Robert F. Kennedy Jr.

In response, Secretary Kennedy and HHS officials made negative public statements against AAP. At issue in this litigation, on December 16, 2025, HHS also “abruptly terminated” almost $12 million in federal grants to AAP, which previously funded “resources for medical providers and facilitate[d] early detection and interventions for various pediatric diseases and conditions.”

On December 24, 2025, AAP brought suit against HHS, the Health Resources And Service Administration, the Centers for Disease Control and Prevention, and the heads of each, challenging the funding termination. In relief, the AAP sought declaratory and injunctive relief to restore the grant funding and prohibit future grant cancellations.The suit was brought in the U.S. District Court for the District of Columbia, and assigned to Judge Beryl Alaine Howell. 

In the complaint, AAP alleged that the funding termination decision was retaliatory action in violation of the First Amendment and Spending Clause because the AAP’s statements were protected activity, the Defendants engaged in viewpoint discrimination, and the Government-Defendants cannot hinge grant decisions on the condition that the grantee may not engage in speech or petitioning activity that the government disfavors. They also alleged that the grant terminations violated the Fifth Amendment’s Equal Protection Clause by treating the AAP differently based on their viewpoint. Finally, they alleged the grant termination decisions violated the Administrative Procedure Act (APA) because they were contrary to constitutional rights.

Contemporaneously with the complaint, AAP filed a motion for a Temporary Restraining Order (TRO) and a Preliminary Injunction (PI) seeking to bar Defendants from terminating the grants at issue and re-obligating the funds, and requiring that the funds be disbursed as scheduled to AAP. The Defendants filed a motion opposing the TRO and PI on December 31, 2025. A hearing was held on the motion in court on January 6, 2026.

On January 11, 2026, the court granted AAP’s motion for a preliminary injunction. 2026 WL 80796. The court found a likelihood of success on the merits of AAP’s claim that the grant terminations were “in violation of the First Amendment’s prohibition on retaliation for engaging in protected First Amendment activity, for engaging in speech that the government disfavors and for petitioning for judicial relief adverse to the government.” The court enjoined the Defendants from enforcing the grant terminations and from re-obligating the grant funds, and ordered the Defendants to “take all steps necessary to ensure that the CDC and HRSA disburse funds on AAP’s Subject Grant Awards in the customary manner and in customary timeframes.”

On January 13, 2026, the Defendants reported to the court that “they have taken the steps necessary to ensure that the Centers for Disease Control and Prevention and Health Resource and Services Administration disburse funds on Plaintiff’s Subject Grant Awards in the customary manner and in customary timeframes.” They also submitted Notices of Award for each of the seven Subject Grant Awards.

MINUTE ORDER (paperless) DENYING, upon consideration of defendants' 11 Motion for Extension of Time ("Defs.' Mot."), plaintiff's 12 Memorandum in Opposition ("Pl.'s Opp'n"), and defendants' 13 Reply to Opposition to Motion, defendants' motion for extension of time.This matter concerns the defendants' termination of three grants administered by the Centers for Disease Control and Prevention ("CDC") and four grants administered by the Health Resources and Services Administration ("HSRA") totaling nearly $12 million. 1 Compl. ¶¶ 12, 32. On the current record, the terminated grants at issue appear to have been longstanding, multi-year awards that would have continued for another nine to forty-five months, with some of these grants approved as recently as 2024, and one in August 2025. Id. ¶ 32. Without prior notice, these grants were terminated on December 16, 2025, with the termination decisions effective on December 22, 2025, for the CDC grants and effective immediately for the HRSA grants. Id. ¶¶ 51, 53. Without the funding provided by these grants, plaintiff will be forced to send termination notices to dozens of employees on January 9, 2026. 2 Pl.'s Mot. for TRO, or, in the Alternative, Mot. for Prelim. Inj., Decl. of Am. Acad. Of Pediatrics's Chief. Exec. Officer, Mark Del Monte ¶ 12.Though the Court appreciates defendants' request for additional time to respond to the "voluminous filing" at issue, Defs.' Mot. at 2, plaintiff correctly point outs that the "urgent situation [is] of Defendants' own creation," Pl.'s Opp'n at 1. While defendants' request for additional time, if accompanied by the parties' agreement for suspension or delay in the effective date of the termination decision during the pendency of this litigation, would address the "urgency," absent such an agreement, the deadlines in this matter will not be extended. The following SCHEDULING ORDER shall control further proceedings: (1) By December 31, 2025, at 4:00 P.M., defendants shall file any opposition to plaintiff's 2 Motion for Temporary Restraining Order, Motion for Preliminary Injunction; (2) By January 2, 2026, plaintiff shall file any reply in support of its 2 Motion for Temporary Restraining Order, Motion for Preliminary Injunction; and (3) As necessary, any hearing will be set following completion of briefing on the pending motion for a temporary restraining order.
