This case challenges the State of Delaware’s refusal to provide voter registration records to the U.S. Department of Justice during a federal investigation into compliance with election laws. 

On December 2, 2025, the Attorney General of the United States filed suit against the State Election Commissioner of the State of Delaware in the U.S. District Court for the District of Delaware. In the complaint, Plaintiff alleged that the suit arose from an investigation into the state’s compliance with federal election law, particularly the National Voter Registration Act and the Help America Vote Act, which require states to maintain and preserve certain records and papers that fall within the scope of Section 301 of Title III of the Civil Rights Act.

According to the complaint, Title III of the Civil Rights Act of 1960 requires state election officials to retain and preserve records relating to voter registration and other acts requisite to voting and to make those records available to the Attorney General upon written demand. The Department of Justice initiated an investigation into Delaware’s compliance with federal election laws, including the National Voter Registration Act and the Help America Vote Act, which require states to maintain accurate and current voter registration records.

The United States alleged that, following a July 2025 request for information and records, it issued a formal written demand on August 14, 2025, seeking a complete electronic copy of Delaware’s statewide voter registration list, including identifying information required by federal statute. Although the State provided some responsive information, the Commissioner ultimately refused to produce the voter registration list, citing privacy concerns under federal and state law.

The complaint asserted a single claim under Title III of the Civil Rights Act of 1960, specifically 52 U.S.C. § 20703, alleging that the Commissioner unlawfully failed to comply with the Attorney General’s records demand. It sought a declaration that the refusal violated the Act and an order requiring production of the complete voter registration list, including all required data fields, along with any additional relief the court deemed appropriate.

Following the filing of the complaint and motion to compel, two individual voters moved to intervene on December 18, 2025.  On January 15, 2026, the court granted their motion and permitted them to participate as intervenor-defendants, including filing a motion to dismiss. On February 3, 2026, a second group of organizations and an individual—including the Latin American Community Center, Delaware Coalition Against Domestic Violence, and others—moved to intervene. The court granted that motion the following day, allowing the additional parties to intervene and participate fully in the litigation. On February 9, 2026, defendant Anthony Albence and both groups of intervenor-defendants each filed motions to dismiss the complaint. That same day, defendant and intervenors also filed opposition briefs to the United States’ motion to compel production of records. Between February 10 and February 20, 2026, additional parties, including the Democratic National Committee and a coalition of state attorneys general, moved for leave to file amicus briefs addressing the issues raised in the motions to dismiss. On February 23, 2026, the United States filed its reply in support of the motion to compel and its consolidated opposition to all motions to dismiss. On March 2, 2026, defendant and intervenor-defendants filed reply briefs in further support of their motions to dismiss, completing briefing on those motions.
