This is a case where female students filed a class action alleging sex discrimination by the university because of its failure to provide equal athletic opportunities for female students based on sex.

On September 25, 2019, two female students at the University of Kentucky (“UK”) filed a class action in the U.S. District Court for the Eastern District of Kentucky against UK, its Director of Athletics, President, and Board of Trustees. The plaintiffs argued that UK discriminated against women by not providing equal athletic opportunities, athletic financial assistance, and athletic treatments and benefits; as such, UK violated the Equal Protection Clause of the Fourteenth Amendment and Title IX of the Education Amendments of 1972. 

The plaintiffs alleged that women comprised approximately 55% of the student population but only 41% of varsity athletic participants in the 2017-2018 academic year, creating a disparity of approximately 183 female athletic opportunities needed for Title IX compliance. The plaintiffs claimed that female students had requested the addition of women's varsity sports, including lacrosse, field hockey, and triathlon, but the defendants refused them despite student interest and ability. The plaintiffs sought class certification for “all present, prospective, and future female students at UK who seek to participate in varsity intercollegiate lacrosse, field hockey, or any other sport not currently offered by University of Kentucky,” as well as declaratory and injunctive relief for the alleged sex discrimination, compensatory and other monetary damages, and attorneys’ fees and costs. The case was assigned to Judge Karen K. Caldwell.

On October 11, the plaintiffs filed the amended complaint, removing one named plaintiff and the corresponding removal of triathlon-related allegations throughout the complaint, while maintaining the same claims structure. On January 23, 2020, the court dismissed a defendant Board of Trustees upon the plaintiff’s motion on January 10.

On November 30, 2020, the court granted in part and denied in part the defendants’ motion to dismiss for failure to state a claim, which had been filed on December 13, 2019. The court dismissed the plaintiff’s equal protection claim and monetary damages on the equal protection claim, stating that, pursuant to the Eleventh Amendment, UK, as an arm of the State, was immune from §1983 claims directly against a state and the Director of Athletes and the President were also immune from monetary damages. It otherwise denied defendants’ motion to dismiss other claims. 2020 WL 7028707. 

On June 3, 2021, the plaintiff filed the second amended complaint to add one named plaintiff. The plaintiff filed the third amended complaint on December 15, 2021, removing the Board of Trustees as a defendant entirely, directing the Title IX claims solely against UK, directing the equal protection claim solely against the individual defendants, and removing the jury demand. 

On March 14, 2022, the court certified the modified class of “[a]ll present and future female students at the University of Kentucky (UK) who are harmed by and seek change of UK's allocation of athletic participation opportunities for female students,” for seeking declaratory and injunctive relief. 2022 WL 22987200. 

The bench trial was held for three days in August 2023. On October 28, 2024, the court entered the order that 1) the plaintiffs’ Title IX claims against UK were dismissed because the plaintiffs have failed to prove that enough female students at UK wanted to and had the ability to compete in the alleged sports at the Division I level, as opposed to the existing club team level; and 2) the plaintiffs' equal protection claim against individual defendants was dismissed. 2024 WL 4891025.

On November 25, 2024, the plaintiffs appealed to the U.S. Court of Appeals for the Sixth Circuit. On January 20, 2026, the court (Chief Judge Jeffrey S. Sutton) affirmed the district court order, saying that the district court did not clearly err in making their finding that there was an insufficient number of female students to form varsity teams. 165 F.4th 460.
