This is a lawsuit challenging the National Park Service's January 22, 2026 removal of artwork and informational displays referencing slavery at the President's House site in Philadelphia. The alterations to the President's House, a collaboration between the City and the United States, were presumably made pursuant to Executive Order No. 14253, issued in March 2025, which, among other things, called for the U.S. Department of the Interior to “ensure that [materials under the jurisdiction of the department] do not contain descriptions, depictions, or other content that inappropriately disparage Americans past or living (including persons living in colonial times).”

On January 22, 2026, the City of Philadelphia filed suit against Doug Burgum, Secretary of the Interior, the U.S. Department of the Interior, and the National Park Service in U.S. District Court for the Eastern District of Pennsylvania. The lawsuit asserted that the defendants’ removal of the artwork and informational displays referencing slavery at the President’s House were arbitrary and capricious in violation of the Administrative Procedure Act because they: failed to consider and violated, without rationale for the change of course, the agreement between the federal government and the City; departed from the National Park Service’s longstanding position related to recognizing and educating about both slavery and freedom at President’s House; and lacked authority to remove the educational panels, in direct contradiction of Congress’s express purpose to preserve and recognize important historical sites of the Underground Railroad.  Plaintiffs sought declaratory relief, an order restoring the President's House to its status as of January 21, 2026, before the alterations, a preliminary injunction enjoining the defendants from taking any action to damage any exhibits, panels, artwork, or other items at the site and requiring the defendants to take all necessary steps to ensure preserve the items removed from the site, and a permanent injunction prohibiting the defendants from removing the interpretative panels referencing slavery without complying with the APA and all applicable law.  The case was assigned to Judge Cynthia M. Rufe. 

Also on January 22, 2026, plaintiffs filed a motion for a preliminary injunction, asking the court to restore the President’s House site to its status as of January 21, 2026 and to enjoin the defendants from taking any action to damage any exhibits, panels, artwork, or other items from the site.  The court held a hearing on the motion on January 30, 2026.  According to contemporaneous news reports, the hearing included an exchange at which an attorney for the federal government expressed that “the government gets to choose the message it wants to convey,” to which Judge Rufe responded "That is a dangerous statement you are making. It is horrifying to listen to." 

On February 2, 2026, Judge Rufe conducted a visual inspection of the displays removed from the President’s House site by the National Parks Service, which were being held in their custody and stored at the National Constitution Center, as well as of the site as it currently stands. In an inspection report issued that same day, the court noted that it was "still to be determined . . . the extent of any damage and the integrity of the exhibits regarding their amenability to being restored to their original condition" and order the government "to continue to securely store all removed panels and to mitigate any further deterioration or damage."

This case is ongoing.
