This putative class action petitions for writ of habeas corpus and challenges the Department of Homeland Security's (DHS) actions in Minnesota. On January 9, 2026, DHS and U.S. Citizenship and Immigration Services (USCIS) launched an operation, Operation PARRIS to reexamine the legal status of Minnesota's 5,600 refugees who have not yet secured permanent resident status. 

The named plaintiffs in this case are refugees who were admitted to the U.S. under the U.S. Refugee Admissions Program. They reside in Minnesota. 

On January 18, 2026, a single Petitioner, U.H.A., filed for Writ of Habeas Corpus in the District of Minnesota. U.H.A. was arrested by ICE on January 18, 2026 while on his way to work. He was detained without a warrant or apparent justification.

The case was assigned to Judge John R. Tunheim. On January 22, 2026, the Judge allowed Petitioner to proceed under a pseudonym for their privacy. An amended petition was filed by U.H.A., joining others in the action, under seal on January 24, 2026. Also on January 24, a Motion for Class Certification was filed with the class definition: "All individuals with refugee status who are residing in the state of Minnesota, who have not yet adjusted to lawful permanent resident status, and have not been charged with any ground for removal under the Immigration and Nationality Act." The plaintiffs asked for a TRO and a Preliminary Injuction.

The plaintiffs asked the court to (1) postpone the effective date of the "Refugee Detention Policy" Defendants have employed in furtherance of Operation PARRIS (2) enjoin Defendants from arresting any member of the putative class in Minnesota on the basis that they are a refugee who has not yet adjusted to lawful permanent resident status, and (3) to order the immediate release of the members of this class who were presently detained under the policy. The court granted the TRO on the latter two requests, but not the first, on January 28, 2026. The following day, the court held that the TRO would last 28 days, rather than the typical 14.  

ICE sought to dissolve the TRO in a motion filed January 31; the plaintiffs opposed the motion and sought contempt sanctions for what they alleged was violations of the court order. After a hearing on Feb. 4, the court kept the TRO in place, and granted plaintiffs discovery, ordering the government to produce all documents cited in motion to dissolve. 2026 WL 357636.   

Soon thereafter, the court allowed the state of Minnesota to appear as an amicus, and heard a motion from a news outlet, "Law Dork" to intervene and make the filings internet-accessible. At a Feb. 11 hearing, the Trump administration stated that it had had rescinded 2010 guidance that barred detaining refugees who had not yet obtained a green card after a year of being in the U.S. Judge Tunheim ordered the relevant rescission memo to be turned over. The court rejected the motion to dissolve the TRO and declined to stay the TRO pending appeal. 

As reported in Law Dork, the memo rescinding the prior refugee detention guidance cited, as its chief authority for the change, a presidential proclamation from two days earlier, "Restricting and Limiting the Entry of Foreign Nationals to Protect the Security of the United States. But that proclamation stated that "This proclamation shall not apply … to a refugee who has already been admitted to the United States.“  DOJ also filed a memo making clear its intent to take the same approach nationwide. 

On February 18, the court rejected Law Dork's motion to intervene, intended to obtain public access to the docket in this case. Judge Micko wrote that intervention would be unnecessary in order to safeguard the public's right to the information, as the public "may already access filings in this case through the public terminals available at each federal courthouse in the district." The court refused Law Dork's request to expand remote hearing access as a matter of policy, holding that members of the public were nonetheless welcome to attend in-person proceedings. Law Dork's prior request to only temporarily seal certain files in the case - particularly the ICE recision memorandum regarding 8 U.S.C. § 1159 - was also denied as moot.

On February 27, 2026, the court granted in part and denied in part Plaintiff's motion to convert the TRO to a longer-lived preliminary injunction. 2026 WL 558824. This decision declined to recognize the Detained Subclass, but granted class certification to all Minnesota residents who have refugee status but who have not yet adjusted to lawful permanent resident status, and have not been charged with any ground for removal under the Immigration and Nationality Act. Defendants were enjoined from detaining any member of this class on the basis of their refugee status. In his opinion, Judge Micko decried that Defendants' new policy "turns the refugees’ American Dream into a dystopian nightmare."

Weeks later, on March 4, Law Dork appealed the denial of their motion to intervene. As reported in their newsletter, the objection reiterated that public access should not be limited to those few who can afford to visit the local courthouse. Rather, as the intervening party's lawyers argued, “[t]he Court should take advantage of the technological means at its disposal to promote the public’s ability to track this case."

On March 12, the government appealed the district court's preliminary injunction to the Eighth Circuit Court of Appeals, and sought a stay pending appeal from the district court.

This case is ongoing.

MEMORANDUM OPINION AND ORDER GRANTING 16 MOTION FOR TEMPORARY RESTRAINING ORDER 1. For the purposes of this Order, temporary relief is granted to a putative Class which encompasses: All individuals with refugee status who are residing in the state of Minnesota, who have not yet adjusted to lawful permanent resident status, and have not been charged with any ground for removal under the Immigration and Nationality Act.2. Defendants are ENJOINED from arresting or detaining any member of the Class on the basis that they are a refugee who has not been adjusted to lawful permanent resident status.3. For the purposes of this Order, relief is granted to a putative Detained Subclass which encompasses: All members of the Class who are or will be detained by DHS pursuant to the Refugee Detention Policy.4. Defendants are ORDERED to immediately release all members of the Detained Subclass. 5. If a member of the Detained Subclass has been transferred out of the District of Minnesota, Defendants shall immediately TRANSPORT such member to Minnesota and then RELEASE such member from custody within 5 days of the date of this Order. They shall not be released at the out-of-District location of detention.6. Given the severe weather conditions in Minnesota, Defendants are ORDERED coordinate with Plaintiffs counsel to ensure that upon such members release, they are not left outside in dangerous cold. In order to ensure humane treatment, Detained Subclass members must be released to counsel or to individuals specifically authorized by counsel. 7. Within 7 days of this Order, Defendants shall file on the docket a status update concerning the status of the Detained Subclass members release.8. Within 48 hours of this Order, Defendants shall produce and file under seal a list of individuals in detention that satisfy that definition of the putative Detained Subclass, as set forth in Paragraph 3 of this Order. The list must disclose the individuals identities and their location of detention.9. Plaintiffs are not required to provide security under Federal Rule of Civil Procedure 65(c).10. Defendants Response concerning a preliminary injunction is due February 9, 2026; Plaintiffs Reply is due February 13, 2026.
