On January 30, 2026, the Greater Boston Latino Network (GBLN) and Brazilian Worker Center (BWC) filed this lawsuit against Department of Homeland Security (DHS) Secretary, Kristi Noem, Immigration and Customs Enforcement (ICE) Acting Director, Todd Lyons, and their respective agencies. Plaintiffs sought to challenge a May 2025 memorandum (the "Lyons Memo") that authorizes ICE officers to enter homes and make arrests using only administrative warrants (Form I-205) without obtaining judicial warrants, consent, or establishing exigent circumstances. They sought a declaration that the Lyons Memo violates the Administrative Procedure Act (APA) and is void, preliminary and permanent injunction blocking implementation of the memo, and attorneys' fees and costs.

District Judge Julia E. Kobick: ELECTRONIC ORDER entered. The defendants’ motion for a three-month extension of the responsive pleading deadline, ECF 16, is DENIED. Should the Department of Homeland Security decide to rescind the Lyons Memorandum after completing its review of that policy, the parties will have the opportunity at that point to address the effect of any rescission on this case. The defendants are, however, given an extension until June 12, 2026 to answer or otherwise file their responsive pleading. The plaintiffs’ motion for leave to exceed the page limit, ECF 17, is GRANTED. The defendants will be afforded the same enlargement of the page limit—to 35 pages—for their memorandum responding to the plaintiffs’ forthcoming motion for summary judgment. Any threshold jurisdictional defenses the defendants wish to raise may, of course, be raised in response to the motion for summary judgment.
