On February 2, 2026, Catholic Legal Immigration Network, Inc. (CLINIC), African Communities Together (ACT), and eleven individual plaintiffs filed this lawsuit in the U.S. District Court for the Southern District of New York against Secretary of State Marco Rubio and the U.S. Department of State. The case was assigned to District Judge Jeannette A. Vargas. The plaintiffs included immigrant visa applicants from the affected countries and U.S. citizens seeking to reunite with family members abroad. They challenged two State Department policies: a January 14, 2026 policy indefinitely suspending immigrant visa issuance to nationals of 75 countries, effective January 21, 2026, and November 6, 2025 consular guidance expanding the considerations used in public-charge determinations. The State Department presented the suspension as a response to concerns that nationals of the listed countries were likely to become public charges, and implemented it by directing consular officers to refuse otherwise eligible applicants under INA § 221(g).

The plaintiffs alleged that the nationality-based suspension prevented otherwise eligible applicants from receiving immigrant visas without individualized determinations of their admissibility. They also alleged that the suspension violated the INA’s public-charge provision by substituting a nationality-based presumption for the individualized public-charge inquiry the statute requires. In addition, they alleged that the revised public-charge guidance improperly expanded the consideration of public benefits, health conditions, and financial circumstances beyond what Congress authorized under the Immigration and Nationality Act (INA). The plaintiffs brought claims under the Administrative Procedure Act (APA) and the Fifth Amendment, alleging that the challenged policies violated the INA, exceeded the State Department’s statutory authority, were arbitrary and capricious, and violated the constitutional separation of powers and equal protection guarantees. They sought declaratory and injunctive relief and vacatur of the challenged policies.

On August 21, 2026, the court granted partial summary judgment in favor of the plaintiffs on their challenge to the nationality-based immigrant visa suspension. The court found that the policy violated the INA’s prohibition on nationality discrimination in immigrant visa issuance, improperly required consular officers to refuse visas to otherwise eligible applicants, and exceeded the Secretary of State’s statutory authority. The court rejected the plaintiffs’ argument that the suspension violated the INA’s public-charge provision, but concluded that the policy’s other statutory violations warranted vacatur. The court therefore vacated the policy and all immigrant visa refusals based solely on it, remanding those applications for further proceedings. 2026 WL 2455099.

On August 26, 2026, the plaintiffs filed an emergency motion seeking enforcement of the court’s judgment and a status conference. During an August 31 conference, the court expressed concern about how the State Department intended to process the affected visa applications. Although government counsel initially represented that the Department would not conduct new public-charge assessments, the Department subsequently indicated that it would reconsider applications using updated public-charge guidance and other adjudication tools, without a fixed deadline for completing the process.

On September 10, 2026, the defendants filed a notice of appeal to the U.S. Court of Appeals for the Second Circuit. On September 14, 2026, the defendants moved to stay the district court’s partial judgment pending appeal.

On September 24, 2026, the district court ordered the parties to show cause why it should not issue an injunction requiring the government to complete reconsideration of the affected applications by a specified deadline. The plaintiffs alleged that the government had delayed compliance with the judgment, reporting that none of the more than 43,000 affected applications had been removed from administrative processing.

On September 25, 2026, the district court denied the defendants’ motion to stay the partial judgment pending appeal. The court rejected the defendants’ argument that the doctrine of consular nonreviewability prevented judicial review, explaining that the plaintiffs challenged the State Department’s general policy rather than individual consular officers’ discretionary visa decisions. The court also found that the defendants were unlikely to succeed on the merits of their appeal and had not demonstrated that compliance with the judgment would cause irreparable harm. In contrast, the court emphasized that continued delays had separated families, prevented access to medical care, and disrupted professional opportunities. Concluding that the balance of hardships and the public interest weighed against a stay, the court denied the government’s request.

On September 28, 2026, the defendants filed an emergency motion in the U.S. Court of Appeals for the Second Circuit, seeking a stay of the district court’s judgment pending appeal or, alternatively, a narrower stay of the relief affecting nonparties. The defendants argued that the district court had improperly reviewed consular visa decisions and granted relief extending beyond the named plaintiffs.

Meanwhile, proceedings continued before Judge Vargas in the district court. On October 6, 2026, Judge Vargas scheduled oral argument for October 14, 2026, concerning the September 24 order to show cause.

As of October 2026, the case remains ongoing in both the district court and the Second Circuit.
