Case Summary

This case challenges a land development company’s practice of discriminatorily targeting Hispanic consumers. On December 20, 2023, the Consumer Financial Protection Bureau (CFPB) and the United States filed this lawsuit in the U.S. District Court for the Southern District of Texas. Plaintiffs sued Colony Ridge Development and affiliated organizations for violations of the Equal Credit Opportunity Act (ECOA) and the Fair Housing Act (FHA). The plaintiffs alleged that the defendants targeted Hispanic applicants on the basis of race or national origin with predatory seller financing and exploited their limited English proficiency. The CFPB also alleged violations of the Consumer Financial Protection Act of 2010 (CFPA), asserting that the defendants misrepresented the infrastructure of lots. Finally, the CFPB alleged that the defendants violated the Interstate Land Sales Full Disclosure Act by selling lots without filing an initial Statement of Record with the Bureau, failing to pay corresponding fees, failing to provide purchasers with Property Reports, and using documents during transactions that were prepared in a language other than that in which the sales campaign was conducted. The plaintiffs sought declaratory judgment, a permanent injunction, damages, restitution, consumer redress, and other monetary relief. This case was assigned to District Judge Alfred H. Bennett.

On February 6, 2024, Colony Ridge filed a motion to stay pending final resolution in the U.S. Supreme Court of Cmty. Fin. Servs. Ass’n of Am. v. CFPB. Defendants argued that the CFPB’s enforcement authority as well as its rules and regulations were subject to challenge in that action, meriting a stay.

On February 13, 2024, Defendant Loan Originator Services, LLC (LOS) also filed a motion to stay for the same reasons. On February 20, 2024, both defendants filed motions to dismiss for failure to state a claim. Colony Ridge argued that the government failed to state a cognizable violation of federal antidiscrimination law. LOS urged that its role was purely ministerial, involving no interaction with consumers, loan terms, or foreclosures.

On September 13, 2024, the court granted LOS' motion to dismiss. Judge Bennett held that the allegations in the complaint did not plausibly allege that LOS intentionally targeted Hispanic applicants with predatory seller financing because LOS played no direct role in advertising, marketing, misrepresenting the infrastructure on the lots, or interacting with consumers. LOS simply provided a software platform that generated documents based on information provided by Colony Ridge. On the same day, the court granted in part and denied in part Colony Ridge’s motion to dismiss, granting the dismissal of the government’s Fair Housing Act (FHA) claim. Judge Bennett held that the language of the FHA governed refusals, denials, and otherwise making a dwelling available. The court noted that Colony Ridge offered Hispanic consumers the opportunity to purchase land, which is conduct that facially contradicted the language of the FHA. As for the rest of the motion to dismiss, the court held that the CFPB’s complaint sufficiently alleged that Colony Ridge intentionally targeted Hispanic consumers through strategic advertising and acted as creditors as defined in the Equal Credit Opportunity Act. 2024 WL 5183711.

On September 27, 2024, Colony Ridge filed a motion for an interlocutory appeal seeking review of the September 13 decision. It also requested that the court stay proceedings pending appeal. Colony Ridge argued that a stay would materially advance litigation while minimizing burdens on both parties and the judicial system. It further argued that a stay pending appeal is warranted when the government is relying on a largely unvetted legal theory. A stay would prevent piecemeal discovery and the future burdens on litigants, third-party witnesses, and the court.

On April 29, 2025, the parties filed a joint motion to stay all pending deadlines in the case, including the pending interlocutory appeal, for mediation. On May 13, 2025, the court granted the parties’ joint motion to stay.

Over the next several months, the stay was extended several times.

On December 3, 2025, the court lifted the stay. 2024 WL 5183711.

On February 10, 2026, the parties filed a joint motion for settlement and requested that the court dismiss the case. The settlement negotiations started under the Trump administration. Under the terms of the settlement, Colony Ridge agreed to invest $48 million in infrastructure improvements, with $18 million specifically invested in drainage infrastructure to address flooding and $30 million towards other general infrastructure improvements; adopt underwriting standards that assess borrowers’ ability to repay; develop policies to meaningfully reduce the number and frequency of foreclosures and defaults; ensure honest and accurate advertisements that truthfully and accurately describe the properties for sale and applicable loan terms; and invest $20 million in increased law enforcement presence.

Pursuant to contemporaneous news reports, at an April 10, 2026 hearing on the parties’ joint motion for settlement, Judge Bennett took issue with a provision that allocated millions of dollars toward immigration enforcement authority. The court noted that this was a reverse redlining case, not an immigration enforcement matter. Additionally, Judge Bennett critiqued the lack of victim compensation and relief afforded in the agreement. Later that day, in response to Judge Bennett’s concerns about the settlement agreement’s structure, the parties filed a notice of voluntary dismissal.

On April 28, 2026, the court dismissed the case. The parties’ joint motion for settlement was denied as moot. 2024 WL 5183711.
