On February 11, 2026, plaintiff states—California, Colorado, Illinois, and Minnesota—filed suit in the U.S. District Court for the Northern District of Illinois against the Office of Management and Budget (OMB), the Department of Health and Human Services (HHS), the CDC, the heads of these agencies, and the President.  Plaintiff states allege that on February 9, HHS began a three-day countdown clock by notifying Congress of its intent to cut more than $600 million in CDC grants to the four Plaintiff States. They further claim that defendants have targeted these four states with devastating funding cuts to basic public health infrastructure based on political animus and disagreements about unrelated topics such as federal immigration enforcement, political protest, and clean energy.  Plaintiffs' complaint raised multiple counts, including violations of the Administrative Procedure Act (APA) for arbitrary and capricious agency action and for exceeding statutory authority, as well as constitutional claims for violations of the Separation of Powers doctrine, the Spending Clause, and the Tenth Amendment. The case was assigned to Judge Manish S. Shah.

Alongside their complaint, the plaintiffs filed an emergency motion for a temporary restraining order (TRO) and a stay under 5 U.S.C. § 705 to stop the termination of the CDC grants. The court granted the TRO on February 12, temporarily blocking the federal government from implementing directives to terminate public-health grants awarded to the plaintiff states and required the agencies to treat any such actions already taken as null and void.

On February 23, the federal government filed a combined motion to transfer the case to the Court of Federal Claims or dismiss it for lack of jurisdiction and failure to state a claim, while also asking the court to clarify that the TRO did not apply to the President. On February 25, the court granted Plaintiff's motion for expedited discovery and clarified that the TRO did not apply to the President.

On March 3, 2026, Plaintiffs filed an amended complaint adding the Department of Transportation (DOT) and the Federal Emergency Management Agency (FEMA) as defendants, alleging the administration was similarly targeting transportation and disaster relief funding. The next day, Plaintiffs filed a motion to enforce expedited discovery, arguing the government was improperly withholding and redacting documents, and Plaintiffs filed a motion for a preliminary injunction (PI) to continue the TRO and enjoin withholding of transportation and disaster relief funding.

Following further briefing, the court entered a PI on March 12, 2026, to continue the effect of the TRO, enjoining the cessation of payments to the statements that occurred after January 13, 2026. The PI also enjoined OMB-level directives to cut funding, but left open the chance for "independent agency determinations" to cut or review funding. The court also declined to enjoin the DOT or FEMA in this PI.

The case remains ongoing.
