On November 15, 2025, Revier Technologies, Inc. and Young America's Foundation filed suit in U.S. District Court for the Eastern District of Louisiana against the U.S. Small Business Administration (SBA), the SBA Administrator, U.S. Attorney General, Pamela Bondi, and the U.S. Department of Justice. The first plaintiff, a Louisiana-based artificial intelligence startup, alleged they were denied federal small business grant funding for socially and economically disadvantaged individuals because their ownership were white, and thus could not "benefit from the presumption of social disadvantage." The second plaintiff, a nationwide conservative
student organization, alleged their members were unable to apply for competitive fellowships on equal footing as their race was not considered "socially disadvantaged" by SBA regulations. Plaintiffs argued that the federal government's use of race as an indicator of social disadvantage was grossly unconstitutional, and that the rule implementing it should be vacated under the Administrative Procedure Act and the Fifth and Fourteenth Amendments of the U.S. Constitution.
This case was assigned to Judge Sarah S Vance and Magistrate Judge Michael North on November 17, 2025. On February 6, 2026, Defendants filed an ex parte motion to stay the case for sixty days. In their motion, Defendants wrote that the U.S. Department of Justice was still considering whether to raise affirmative defenses to "any provision of any Federal statute, rule, regulation, program, policy, or other law." That motion was granted on February 9, 2026. Defendants’ response to the complaint is now due April 14, 2026.
